Amazon Brings DraftKings to Thursday Night Football

After spending $1 billion to acquire the rights to broadcast NFL’s Thursday Night Football (TNF), Amazon is adding a sports betting element to the broadcast. DraftKings will offer TNF-branded bets and promos at its sportsbook. They will also provide odds for the game, which is on Amazon Prime Video for the multi-year deal, according to Games Magazine Brazil.

“The NFL season is the most active time of year for our customers, so collaborating with one of the world’s leading technology brands in order to offer engaging content to viewers of TNF on Prime Video is a tremendous opportunity for DraftKings,” said DraftKings CMO Stephanie Sherman.

“Prime Video is an innovator in live content and we both have a similar focus on constantly improving our customers’ experiences. We look forward to working with Amazon to bring millions of viewers a premium and enhanced experience during TNF on Prime Video all season long and for years to come.”

Broadcaster Al Michaels will be able to openly acknowledge the odds during the game.

“We are thrilled to collaborate with DraftKings to bring fans more insights and excitement as part of the TNF viewing experience,” said Danielle Abrams Carney, head of NFL sales, Amazon ads. “DraftKings content will contribute to pregame discussions, fan engagement, and maybe bold predictions from our on-air talent.”

LeoVegas New Betting Partner with Manchester City FC

If you’re wanting to improve your visibility in sports, entering an agreement with Manchester City, the Premier League football team, is a wise way to go. LeoVegas did just that.

The operator will become the team’s betting partner in Europe and Canada. As part of the deal, the LeoVegas brand will be featured on the first team training kit as well as within the stadium, according to Gambling Insider.

LeoVegas, owned by MGM Resorts, says the partnership with the football club will strengthen its offering and visibility to those that follow the sport.

Co-branded content is another element to the deal, with joint merchandise being released for Manchester City’s men’s and women’s first teams.

“Manchester City is colossal in the sport, with the same leading mentality as LeoVegas; this collaboration is an opportunity for LeoVegas to build further brand awareness to support our global growth,” said LeoVegas CEO Gustaf Hagman.

“We look forward to working together to bring fans and customers even closer to the club. We are excited that this new partnership will also help spark further growth across Europe and Canada and allow us to continue reaching audiences around the world.”

Betting on Tennis Open in New York Not There Yet

Division 1 college football, the NFL and the MLB postseason are manna for sportsbooks. The U.S. Open tennis matches in Queens? Not much of a draw, even with sports betting legal in New York.

Heck, Labor Day at the Open was AWOL as far as sportsbooks, according to US Bets.

“The sport of tennis has perhaps been more conservative than others in inviting that aspect of fan engagement into its universe,” Kirsten Corio, the U.S. Tennis Association’s chief commercial officer, recently told Adweek.

“We understand that it’s here to stay, and that many fans do consider that an important part of their engagement with a live sporting event—and that evolution is inevitable. But how that comes to be embraced by official tournaments and official governing bodies like ours is still a work in progress.”

Joe Favorito, a sports media consultant and a professor at Columbia University, told US Bets that U.S. Open officials have an excellent opportunity in coming years.

“Kiosks on site and betting parlors taking dollars at Wimbledon and the Australian Open were in place over 20 years ago, and there is so much data that shows how much betting already occurs in tennis,” Favorito said. “So the U.S. Open taking on a betting partnership—maybe numerous ones—will get a pretty immediate return on investment as the dollars and sponsorship works its way forward in the next few years.

“It’s hard to think of an event anywhere in the world where sports gambling is legal that hasn’t enjoyed the engagement and the revenue from gambling thus far, other than the Open,” Favorito added. “And when it does get sorted through, it should be a nice additional enhancement for fans on site as well as for the partners.”

Abrams Pitches Sports Betting in Georgia—Kemp Opposes

In 2018, Georgia gubernatorial candidate Brian Kemp opposed legalizing sports betting. In 2022, Kemp has not taken a position on the subject, his spokesperson Tate Mitchell said. But in general he opposes gambling.

Democrat Stacey Abrams, who is running against Kemp this November as she did four years ago, criticized the governor, saying the state is losing potential tax revenue to neighboring Tennessee, which has legal gambling.

Abrams’ campaign released an online ad which featured the popular Georgia Bulldogs football team.

“While Georgians still place bets, Kemp is forcing them out of state to do it, taking the tax dollars with them,” the ad says.

Abrams said that if elected, she would push for a constitutional amendment allowing sports betting and casino gambling.

FanDuel Sportsbook Now Live at Kansas Star Casino

Boyd Gaming and bookmaker FanDuel have teamed up to open a FanDuel Sportsbook inside of Boyd’s Kansas Star Casino. An opening ceremony took place September 8, the same day that sports betting operators started taking wagers in Kansas.

As of now, all of Kansas’ four state-owned casinos—including Kansas Star—are accepting in-person bets, and there a total of six mobile platforms now taking wagers as well: FanDuel, Caesars, BetMGM, DraftKings, PointsBet and Barstool.

The new FanDuel Sportsbook features four betting windows, 20 betting kiosks, and a massive wall of state-of-the-art TV monitors, as you’d expect in any modern sportsbook.

David Strow, vice president of communications for Boyd, told local outlet KWCH that once the legislation was approved, it was a race against the clock to get the facility ready.

“Since we had the go from the legislature passing legislation, we’ve been pretty much working triple shifts to get this place ready,” he said.

FanDuel’s Vice President of Retail Operations Jeff Lowich, told KWCH that he feels confident the new property will be successful due to the fact that the Midwest is “a very sport-hungry part of the country,” for both collegiate and professional sports.

Kansas sports betting officially went live September 1, but the first week was considered as a “soft launch” due to the fact that most facilities and platforms were not 100 percent ready to go at that time.

PointsBet Retail Sportsbook Now Open at Riverboat on the Potomac

PointsBet has announced the opening of its newest retail sportsbook, at Maryland’s Riverboat on the Potomac casino.

The facility features over 20 HD monitors, as well as food and beverage options and a luxe seating area. PointsBet said in a release that the new sportsbook offers an “elite sports viewing and betting experience.”

The bookmaker’s Senior Vice President of Corporate Development, Paul Hannon, said in a statement that PointsBet is “delighted to commence operations with The Riverboat team in the brand-new sportsbook overlooking the beautiful Potomac River. This is a seminal achievement for the partnership and Maryland’s gaming industry at large as the launch represents the first Minority Business Enterprise to go live with licensed gaming in the state’s history, in line with the spirit of legislation.”

He added: “We look forward to the prospective opportunity of bringing the renowned PointsBet mobile product to Maryland next and in doing so further enhancing The Riverboat’s equity and inclusion in the space.”

The opening comes at an opportune moment for sports bettors, as this is one of the busiest times of the sports calendar—MLB is gearing up for the playoffs, and the NFL, NBA and NHL are just starting to get their regular seasons underway.

Arthur Ellis, a state senator in Maryland, told Yogonet that he is “proud of the work the members of our delegation, Senator Jackson, Delegate Proctor, Delegate Davis, Delegate Patterson, and Delegate Wilson, have put into the sports wagering bill.”

“We fought hard for the sports betting industry in Maryland to be inclusive of both Charles County and minority businesses. The partnership between the Riverboat and PointsBet is a success on both fronts, proof that Maryland can be a leader in equity,” Ellis added.

Maryland marks the 12th U.S. jurisdiction for PointsBet—the company first ran an initial “beta test” of the site in August before going public.

Maryland Sports Betting Agency Adds Diversity Condition

The Maryland Sports Wagering Application Review Commission (SWARC) voted September 2 to approve a policy amendment which requires operators awarded a mobile license to submit a diversity plan. However, failure to comply does not mean relinquishing the license that has already been awarded, according to Maryland Matters.

From the time they are approved, licensees have 30 days to submit the plan, which needs timelines and benchmarks to achieve diversity objectives. The licensee must make a good faith effort to meet those objectives, report statistics to the lottery and state gaming commission and make the plan open for public scrutiny.

“SWARC will consider any type of diverse group where an applicant can demonstrate that an individual has been disadvantaged and, therefore, inclusion of the individual as a participant in the diversity plan would be beneficial,” according to the addendum.

Officials were able to start taking applications after a legislative panel approved proposed regulations governing the application process. That approval came hours after gaming officials amended the proposed rules to require that each applicant for the competitively awarded license submit a diversity plan.

The diversity plan requirement may be only a first step in what is expected to be a greater effort to ensure racial and gender equity in licensing.

A commission member asked the question that many were thinking: what would happen if a diversity plan were deficient?

“There’s no opportunity of cancelation of the license. The license has been awarded,” said Assistant Attorney General David Stamper.

James Butler, managing director of organizational compliance with the state’s lottery and gaming control agency, said they would work to ensure applications meet diversity standards.

Despite the cart-before-the-horse approach, Delegate Darryl Barnes, who chairs the Legislative Black Caucus of Maryland, is pleased with SWARC’s effort to ensure equity and inclusion as part of the process.

Still, Barnes said the approval process could be improved if the application and diversity plan were done together.

“It’s something that we can work towards,” he said.

Another goal is to create an environment where entrepreneurs from Maryland have a fair chance to compete against big operators such as FanDuel and DraftKings.

Meanwhile, the state has published proposed regulations for awarding competitive licenses for additional gaming locations and mobile sports wagering licenses. A section on economic impact notes the impact would benefit small businesses, especially those that are certified in the state’s minority business enterprise program.

“Participation for contractors and vendors that provide support to the sportsbook licensee and operator could also be meaningful,” according to the proposal. “Once these small businesses become either licensed, certified, or registered with the Maryland Lottery and Gaming Control Commission, it provides them with the opportunity to offer their goods and services to other sport wagering facility licensees and operators and mobile sports wagering licensees.”

When the state passed sports wagering, it did so with the goal of promoting diversity in the industry, Senate President Bill Ferguson and House Speaker Adrienne A. Jones said in a statement. “The regulations require sports wagering licensee applicants to seek out minority investors, to use the State’s nationally recognized minority business enterprise program in contracting and submit a substantive diversity plan will help achieve that goal. We are confident that these measures will ensure meaningful minority participation in this new industry.”

The commission held a public hearing on the regulations September 9 in Baltimore.

According to the Daily Record, state gaming officials on September 6 started accepting licenses for mobile sports betting in Maryland. As many as 60 licenses are available. Another 30 licenses are good to go for physical locations.

“This is fantastic news,” said Maryland Lottery and Gaming Director John Martin. “We know sports fans are eager to have mobile wagering, and we also know that it will substantially increase the contributions to education funding, so we’re eager, too. We’ve been doing everything we can to have it launch before the end of the year, and now we have a good chance to make that happen.”

Gaming experts and officials say the mobile licenses will be lucrative in the fledgling industry.

“Maryland Lottery and Gaming has been hard at work on background investigations,” Martin said. “A number of businesses that are planning to apply have already submitted information to get their investigations started, and our licensing staff will continue guiding them through the qualification procedures. We’re focused on expediting our part of the process so mobile betting can start as soon as possible.”

A study to determine if other measures are needed has yet to be completed.

The long-awaited announcement comes 10 months after the state awarded its first five licenses. All went to five of the state’s six casinos for physical betting parlors.

To date, the state awarded roughly a dozen licenses to physical locations. State law designated some licenses to go to businesses already licensed by the Maryland Lottery and Gaming Control Agency. That list included all six casinos; Laurel and Pimlico racetracks; several off-track betting locations, including at the Maryland State Fairgrounds in Timonium; and two large bingo parlors in Anne Arundel and Calvert counties.

Of the state’s six casinos, only the Rocky Gap facility in western Maryland has opted not to apply.

Applicants will have until October 21 to apply for either a mobile or retail sports wagering license. Those applicants have an additional 30 days to supply materials required for background checks.

Gaming officials said they could need up to 45 days to review each application. State lottery officials will have to recommend qualified applicants to SWARC for final approval.

The timeline means the state did not have mobile sports betting for the opening of the NFL season. Governor Larry Hogan, a second-term Republican, has repeatedly chided the state review commission for not speeding up the process in order to take mobile bets by September. 8.

“After having to overcome numerous bureaucratic hurdles from the legislature’s commission, we’re finally seeing some progress on mobile betting,” said Hogan in a social media post. “I am going to keep holding everyone’s feet to the fire until this is up and running. Marylanders have waited long enough.”

Virginia Sports Betting Market Adjusting to Closure of Tax Loophole

When Virginia set up the regulations for legalized sports betting, the legislation allowed sportsbooks to provide incentives to attract new customers without paying taxes on the promotions.

The state failed to consider the impact of the tax-free marketing and how it affected the expected tax revenue, according to WRIC.

The Joint Legislative Audit and Review Commission estimated sports betting would result in as much as $55 million a year for the state. But revenues have fallen short, said Delegate Mark Sickles. Lawmakers underestimated how much operators would utilize the promotions.

“In the original legislation, we made a mistake by saying they could deduct,” Sickles said. “I believe it’s a totally inappropriate role of government to be encouraging people to gamble.”

During the state budget discussion in July, the legislature closed this loophole as of July 1.

From July 1 and July 31, 2022, Virginia collected $3.1 million in tax payments, an increase of $1.8 million from June 2022. Virginians bet $29 million more in June, too. Operators cut promos and bonuses from almost $8 million in June to around $400,000 in July.

“This is before the college football season starts. Before the NFL season starts, it should have a major effect this fall,” Sickles said.

Sports betting revenues carry a 15 percent tax on adjusted gross revenue, with the taxes going to the general fund and for the Problem Gambling Treatment and Support Fund.

BetMGM, Arizona Cardinals Open First Sportsbook at NFL Stadium

On September 8, BetMGM, a leading sports betting and iGaming operator, and the Arizona Cardinals debuted the first sportsbook at a National Football League stadium.

The two-story, 17,000-square-foot BetMGM Sportsbook at State Farm Stadium offers state-of-the-art sports wagering amenities, concert-hosting facilities, a gourmet grille and bar and a variety of screens to watch games.

“The BetMGM Sportsbook at State Farm Stadium is one of the most revolutionary additions an NFL stadium has seen in decades and unlike anything fans have encountered on gamedays,” said BetMGM CEO Adam Greenblatt. “BetMGM shares the Arizona Cardinals’ vision in pursuing new ways to break barriers and entertain fans.”

The sportsbook will operate on both event and non-event days, offering guests a massive 265-square-foot video wall, 38 televisions and indoor-and-outdoor dining options, all close to trading windows and user-friendly betting kiosks.

Cardinals owner Michael Bidwill said, “We are proud and thrilled to be the NFL’s first team to offer its fans this type of unprecedented amenity and innovative experience. The BetMGM Sportsbook at State Farm Stadium gives us a chance to engage current and potential fans on a year-round basis in a fun, entertaining and responsible way.”

The BetMGM Sportsbook opened to the public on Sunday, September 11 as the Cardinals opened the 2022 regular season against the Kansas City Chiefs. It complements the BetMGM mobile app that launched statewide in Arizona in 2021.

Hard Rock Sportsbook Expands To Indiana and Tennessee

On September 6, Hard Rock Sportsbook touched down in Indiana and Tennessee with its mobile app.

“Hard Rock Sportsbook plans to engage its players with one-of-a-kind integrated in-person and online experiences rooted in Hard Rock’s legendary entertainment,” the Seminole Tribe’s gaming and hospitality brand said in a press statement.

Indiana houses the Hard Rock Casino Northern Indiana, where a retail sportsbook opened in May. Tennessee has three Hard Rock Cafes in Nashville, Memphis, and Pigeon Forge, and the Bristol Casino, located just across the Virginia state line. The Bristol Casino opened as a temporary venue back in July, ahead of the permanent property in 2024.

The Hard Rock Sportsbook has plans to enter Ohio and Illinois and once a lawsuit is settled, according to Yogonet Gaming News.

IGT PlayDigital Expands Partnership with SKS365

International Game Technology PLC announced that IGT PlayDigital has grown its partnership with Italy’s SKS365 Group through an expanded multi-year content agreement.

SKS365 Group is the international sports betting and gaming operator of Planetwin365 casino and one of the largest operators in the Italian market. As part of this deal, Planetwin365 casino will leverage IGT PlayDigital’s high-performing remote game server (RGS) to offer an expanded content library with new PlayCasino games across the region.

Gov. Murphy Keynote at 25th Annual East Coast Gaming Congress

New Jersey Governor Phil Murphy will deliver a luncheon keynote address at the 25th Annual East Coast Gaming Congress & NexGen Gaming Forum (ECGC), to be held September 21-23 at the Hard Rock Atlantic City. This will mark the fourth time that Murphy has addressed the conference.

“Governor Murphy’s appearance this year will be particularly noteworthy, as this is our Silver Jubilee event. How fitting to have a governor who shares our vision that gaming is a proven pillar of the state’s economy, and that Atlantic City is the centerpiece for all of gaming throughout the entire Eastern Region,” said Lloyd D. Promotion Tax Deduction Not Accepted in New York, New Jersey

Sportsbook operators spent millions in promotional fees to attract bettors when New York launched its mobile system. At the end of the day, most sports betting companies lost a ton of money to sign up new customers. Unfortunately, the state did not allow the promotions to be deducted as an expense.

Still, nationwide, firms saved $120 million in potential tax liabilities, according to a recent report by Vixio GamblingCompliance. State governments lose out as a result of the savings.

The report identified ten jurisdictions that permitted operators to fully deduct free bets and other promotions used to sign up gamblers. For example, sportsbook companies in Michigan and Pennsylvania deducted almost $337 million from their taxable revenues in 2021, saving more than $76 million.

“The full deductions have helped to make Pennsylvania a major sports betting market despite a headline-grabbing 36 percent tax rate that operators once scoffed at, with promo deductions lowering the effective tax rate in the Keystone State to a more reasonable 24 percent in 2021,” the report says.

On the other hand, New Jersey allows limited promotional deductions; $90 million a year for all types of gambling, Vixio said.

“Legislation in 2021 that would have permitted New Jersey online betting operators to deduct any promotional play over $12 million annually was vetoed by Gov. Phil Murphy, who instead allowed the deductions exclusively for retail sports wagering,” the report said.

Legislation passed this year is aimed at scaling back the deductions in Colorado and Virginia.

Arizona and Ohio inserted “sunset clauses” into the sports-betting bills they passed last year to slowly eliminate the deduction claims.

“Provisions allowing deductions in the early days of a sports betting market that phase out over time have recently become a popular move for states, enabling operators to acquire customers early on with the state benefiting in the long run from a full amount of taxable revenue,” the report says.

New York is one of nine states that does not allow the deduction.

“The result has been several operators slowing their customer acquisition efforts in recent months after a brief explosion of inducements offered after the state’s January launch,” VIXIO’s report states. “Other major markets that do not permit bonus deductions include Illinois, Indiana and Tennessee, all of which passed bills legalizing sports betting in 2019 before the promotional play clause became a more popular item to include in any new legislation.”

Gaming Execs Go Bald For a Cause

Is there nothing more heartbreaking than to get the news that a child has cancer? In addition to being heartbreaking, it’s frustrating because unless you are a medical professional there’s not much you can do. It gets even more frustrating when you consider these facts about childhood cancer.

  • Less than 10 percent of funding from the National Cancer Institute goes towards research on childhood cancers;
  • Pharmaceutical companies spend very little money on childhood cancers because the drugs that they need are not profitable!

Enter the St. Baldrick’s Foundation. It started as a small event in 1999 at a New York City tavern that shaved 17 heads with the goal of raising $17,000. When they actually raised over $100,000, the possibilities became endless. The first million was raised by 2002 and a couple of years later the foundation was formed.

The St. Baldrick’s Foundation is a donor and volunteer run charity organization that raises money to support childhood cancer research. They are the largest non-government funder of childhood cancer research grants in the U.S. with more than $300 million in research grants issued since 2005. St. Baldrick’s raises most of their funds through their signature head shaving events in which fundraisers solicit donations in exchange for having their heads shaved.

That frustration got to Dan Ingster early. The vice president of slot operations at the Seminole Hard Rock Tampa joined the effort a decade ago and has been participating every year since.

“I have shaved my head for St. Baldrick’s each of the past 11 years and my friends and acquaintances have donated more than $130,000 over that time,” he said. “This year I worked with Mike McKiski and Landon Jones to create Team MaxBet Media and recruit an amazing group of 15 gaming industry executives from various slot machine manufacturers and casinos. This team has set their rivalries aside to go bald in support of these kids and to help find a cure.”

Steve Walther, vice president of game development at AGS, explains his motivation for joining the challenge.

“I am doing this as an opportunity to give to those in need who often have no choice for the situations that they find themselves,” he says. “If this simple act makes even the slightest difference it is worth it. For me, the hair grows back and money can be replaced, but the life of a child and the impact on their family cannot.”

Ingster says this year’s challenge is on course to be the biggest yet.

“Team MaxBet Media set what we thought would be a tough goal of $50,000 but we are on pace to blow that away with more than $47,000 already raised with 1 month to go. We are now shooting for $75,000! Another long time participant in the effort are the owners of McMullan’s Irish Pub in Las Vegas on Trop across from The Orleans. Brian and Lynn McMullan have hosted these events at their pub for the past 15 years in honor of their daughter Kyra who passed away 20 years ago from cancer. They shave hundreds of heads raising hundreds of thousands of dollars every year. Last September they set an event record and hosted the top head shaving event in the country with more than $1 million raised. On Saturday, September 17th starting at 1 p.m. PST Team MaxBet Media will be shaving their heads at the St. Baldrick’s event at McMullan’s.”

Penn to Own 100 Percent of Barstool Sports

Penn Entertainment, formerly Penn National Gaming, is exercising its option to buy all remaining shares of its sportsbook partner Barstool Sports, which will now become a wholly owned Penn subsidiary.

Penn first purchased 36 percent of Barstool common stock in February 2020 for $161.2 million. That purchase agreement gave them the option to pay an additional $62 million to push its ownership in Barstool to half, and another $325 million to buy out the remaining half of the sports betting and media company’s stock.

The company, now known as Penn Entertainment, announced it had acquired the 50 percent stake in a previous filing with the U.S. Securities and Exchange Commission (SEC), and said in a new filing last week that it has exercised the “call rights” to bring its ownership of Barstool to 100 percent.

Dave Portnoy, the flamboyant founder and president of Barstool Sports, started the company in 2003 as a gambling newspaper. From there, the company created a blog and grew to feature videos, podcasts and online content, normally dealt with an irreverent, humorous flair that has generated a cult-like following among its mostly college-aged fans, and has made Portnoy an internet celebrity—he is affectionately known as “El Presidente” to his followers.

Barstool has since expanded into the sports betting industry, first with its mobile Barstool Sportsbook app in 2020, and now with retail locations across numerous states, primarily on the East Coast. According to Penn, the Barstool app has more than 72,000 registered customers in Pennsylvania alone and has generated nearly $300 million thus far.

The company’s growth has been impressive, but not without controversy, as regulators in Nevada and Indiana are currently looking into allegations of violent sexual misconduct lodged against Portnoy, reported by the Insider news site.

Portnoy, who has denied the allegations, has sued the news outlet, claiming the reported interactions with five women were consensual. “There will be no settling,” Portnoy wrote in a February blog. “No amount they can pay me to get them off their backs. I won’t rest till I put these people out of business.”

Penn CEO Jay Snowden said in March that the company stands by Portnoy.

In addition to Portnoy reaping the benefit of the $450 million valuation of the company—his net worth is estimated to hover around $100 million—the other main shareholder of Barstool Sports is The Chernin Group (TCG), a California-based investment firm specializing in media companies. TCG made a $25 million investment in Barstool in 2016 and 2018, valuing the media property at $10 million-$15 million, and then at $100 million.

The Barstool acquisition is the latest diversification into the media and sports verticals that led Penn National to change its name to Penn Entertainment. Last year, the company acquired TheScore, a Canadian digital media company, for $2 billion. In a note to clients last week, Roth Capital analyst Edward Engel predicted that Penn Interactive, which includes Barstool and TheScore, could achieve profitability by the fourth quarter of this year.

The acquisition is expected to close by February 2023.

IG Report: Official Lied About Blocking Conn. Tribes from Casino

A report from the inspector general (IG) of the U.S. Department of the Interior reveals lies from the former head of the department surrounding the 2017 efforts of Connecticut’s Mashantucket Pequot and Mohegan tribes to jointly open a commercial casino in the state.

The IG report says former Trump administration Interior Secretary Ryan Zinke lied to investigators who were probing whether he wrongly blocked the casino due to lobbying on behalf of MGM Resorts, which was planning its Massachusetts casino near where the tribes wanted to place their new venture. The IG investigation was launched after Politico reported that Zinke had been pressured to reject the casino by lobbyists and Nevada lawmakers, even after Interior analysts recommended approving it.

“We found that Secretary Zinke and the (chief of staff) made statements to (Inspector General) investigators with the overall intent to mislead them,” the report said. “We found that both Secretary Zinke and COS made statements that presented an inaccurate version of the circumstances in which the (Department of the Interior) made key decisions. As a result, we concluded that Secretary Zinke and COS did not comply with their duty of candor when questioned about their respective involvement in the DOI’s decision.”

The Interior Department further noted that Zinke, who is running for a congressional seat in Montana, pressed the IG’s office to withhold the report until after the November election.

“In his comments, Secretary Zinke cited DOJ guidelines and contended that we should postpone release of this report until after the conclusion of the November 2022 election in which he is seeking public office,” the report said.

A lawyer for Zinke criticized the timing of the report’s release.

“On the eve of an election, the IG has released a misleading and inaccurate report that suggested Secretary Zinke lacked candor in his interview with IG agents,” Zinke’s attorney, Danny C. Onorato, said in an emailed statement to Politico. “That is wrong. The content of the IG report and the timing of its release will be seen for what it is, another political smear.”

Maryland’s Rocky Gap Casino Changes Hands

Nevada-based Golden Entertainment last week sold its only non-Nevada property when it made a deal to sell Maryland’s Rocky Gape Casino to Century Casinos and gaming REIT VICI. Century will pay $56.1 million for the gaming operations, while VICE will send $203.9 million to Golden.

Rocky Gap has 626 slot machines and 16 table games, across a 25,000-square-foot gaming floor and a 198-room hotel, as well as five restaurants. It’s located near Cumberland, on 270 acres along Lake Habeeb.

Golden acquired Rocky Gap seven years ago when it bought the gaming properties of Lyle Berman, the founder of Grand Casinos and a member of the Gaming Hall of Fame. Since that time, they’ve been a good neighbor, according to Allegany Commission President Jake Shade.

“Golden has been great to work with, and I’m sure this new company will be as well,” he said. “Rocky Gap Casino continues to generate record revenue – not just as an economic driver, but by putting a tremendous amount of money right back in the community … I’m sure that relationship will continue to expand, and we’re excited to have them here. Hopefully, they will continue to grow, and we look forward to meeting the new folks.”

Blake Sartini, the chairman and CEO of Golden, thanked the team members for “consistently deliver a premier gaming and entertainment experience to our guests.”

“Since Golden began operating Rocky Gap seven years ago, we have invested our resources to enhance the property’s amenities and our contributions to the State of Maryland,” he continued. “We are confident that Century Casinos will be a terrific operator of Rocky Gap and strong partner to the community going forward.”

Golden Entertainment owns nine casinos in Nevada. The sale allows the company to focus on their core assets as well as one of Nevada’s largest slot routes.

VICI Properties was a spinoff of Caesars Entertainment and earlier this year bought MGM Growth Properties. It and owns 43 gaming destinations, most notably Caesars Palace in Las Vegas, Nevada. Century Casinos owns casinos in Colorado, West Virginia, Missouri and Alberta, Canada.

John Payne, president and chief operating officer of VICI Properties, said, “We are very excited to expand our existing partnership with Century, given their strong track record of integrating and operating similar high-quality regional resort assets, while also working with Blake Sartini, Charles Protell and the team at Golden Entertainment to help them achieve their strategic objectives. This transaction allows each of our companies to efficiently create value for our respective shareholders.”

The deal is expected to close in mid-2023.

Justice Department Wants Seminole Compact Reinstated

The Biden administration has urged an appeals court to reinstate Florida’s 30-year gaming compact with the Seminole Tribe of Florida, which gave the tribe control of sports betting throughout the state.

The deal was signed last year by Governor Ron DeSantis and Seminole Tribe Chairman Marcellus Osceola Jr., and ratified by the state legislature in a special session last year. But the owners of Magic City Casino in Miami-Dade County and Bonita Springs Poker Room filed a lawsuit claiming the sports betting arrangement violated federal laws and would cause a “significant and potentially devastating” impact on their businesses.

The sports betting plan, known as “hub-and-spoke,” would allow gamblers throughout the state to place bets online and be processed through computer servers on Seminole property. The compact stated bets made anywhere in Florida “using a mobile app or other electronic device, shall be deemed to be exclusively conducted by the tribe.”

Last November, Washington, D.C.-based U.S. District Judge Dabney Friedrich ruled the arrangement violated the federal Indian Gaming Regulatory Act. In addition, Friedrich invalidated other parts of the compact, noting Interior Secretary Deb Haaland was wrong to let the compact take effect last summer.

In their recent motion to the appeals court to reinstate the compact, U.S. Department of Justice (DOJ) lawyers, representing Haaland, said Friedrich was mistaken, since the compact only authorized gambling on tribal lands and Haaland was obligated to allow it to go into effect.

In a 75-page brief, DOJ attorneys wrote, “The secretary has no duty, nor even any authority, to disapprove a compact that validly authorizes gaming on Indian lands simply because the compact also contemplates that the state will enact legislation permitting persons outside Indian lands to participate in that gaming.”

In a separate brief, tribal attorneys said the Seminoles have “a broad and particular interest in maintaining the 2021 compact, which is critical to the resolution of continuing discord between the tribe and parimutuel facilities, and to healing the long-standing rift between the tribe and the state.”

Besides giving the Seminoles control over sports betting, the compact allowed the tribe to offer craps and roulette at its casinos and to add three casinos on tribal property in Broward County. In exchange, the tribe would pay the state a minimum of $2.5 billion over the first five years and possibly billions more over three decades.

Last fall, the Seminoles briefly launched a mobile sports-betting app but stopped accepting online bets following Friedrich’s ruling. While the app was operational, from October 2021 through February 2022, Florida received $187.5 million, according to state economists.

Temporary Bristol Casino Generates $11.7 Million In First Month

In its first week of operation, through July 14, the Bristol Casino, future home of Hard Rock, generated $3.74 million in adjusted gross gaming revenue (GGR).

The casino produced another $8 million in the final 17 days of the month for a total of $11.71 million in adjusted GGR, according to Virginia Lottery figures. The casino’s 870 slot machines produced $10.23 million and the 21 table games produced $1.48 million. The state of Virginia received $2.1 million in tax revenue, including more than $703,000 that will be shared by local governments.

Since opening, the temporary casino has welcomed guests from 49 states, all except Alaska. Hard Rock Bristol President Allie Evangelista said, “We couldn’t have asked for more. We knew it would be a positive opening. We knew that the community was excited about it and the team members were excited about opening the property, but I don’t think I could have anticipated the excitement that came with the feedback we received. The first six weeks have been a dream come true and since it’s only a temporary property I can only anticipate a buildup from here on until we open the permanent casino in 2024.”

Shortly before the Bristol Casino opened, Hard Rock announced a new customer loyalty program, Unity by Hard Rock. Evangelista said so far, 33,000 people have signed up for it in Bristol. She said the casino’s July 22 report indicated:

  • 4,500 loyalty program patrons drove 100 or more miles to Bristol.
  • 65 percent of loyalty guests live within 60 miles of Bristol.
  • 21 percent, or 6,000 loyalty guests live in Sullivan County.
  • About 1,300 loyalty members come from the Knoxville, Tennessee area.

Evangelista said the main complaint she’s heard from visitors’ concerns smoking on the gaming floor. She said, “That was the biggest pushback. First, we are a smoking facility, and we have that all over the country. There are casinos that are fully non-smoking and fully smoking. Here the gaming floor is smoking with a non-smoking gaming area. Then everything outside the casino floor is non-smoking.”

Evangelista explained Hard Rock had to rent HVAC units when the venue first opened. Those units “were not the capacity we have now. We finalized the exchange from the rental to the units we own that use 100 percent outdoor air on August 8. There is a different flow on the gaming floor now. We have what we call ‘smoke eaters.’ That is a filtration system that gets placed in casinos for that reason. It’s a much cleaner air,” she said.

Evangelista noted the air in the gaming area is “a lot better” and typically smoke is “much lighter and less noticeable” during weekdays and lower traffic times, compared to the busiest periods Friday and Saturday nights.

The casino also has a non-smoking gaming area and, in response to concerns, has added a new entrance. “There is a cage there so you can make transactions in there without having to go to the main floor. That should help, especially if guests have a more allergic reaction, that’s a better experience for sure,” Evangelista said.

Also, she said access to the casino’s 21 table games has been an issue; some were fully occupied or weren’t open. She noted as a temporary facility in a new market, the demand for table games versus slots was not known. “When guests come in and are excited to play on a blackjack table on a Saturday night and we’re full, I can understand the frustration. Typically, 90 percent of revenue comes from slots. That is the standard. Typically slot machines are the bread and butter of the business but also something easier to manage, from the overhead, labor and training, it’s much easier to turn on a slot machine than to train a table games dealer that takes years to become proficient on the job. There is a little bit of that,” Evangelista said.

She added, “We are looking to add a few games to the floor, hopefully before the holidays. But you can’t just press a button and say, ‘Amazon, ship me a blackjack table.’ There are vendors that are authorized by the Virginia Lottery but it’s 12 weeks out before we can get new furniture in. We have to get approval from the Virginia Lottery, so it’s several months to make a change in the layout.”

The casino is expecting 63 new slots as well within one to three months. Evangelista said, “That is a brand-new product not available in the state yet. Once it gets approved that will be added to our gaming floor, so I’m excited about that.”

The venue has about 600 employees, Evangelista said. “We are properly staffed. We have some positions we’re still trying to fill. We have several dozen team members still awaiting lottery licensing.”

The facility has two restaurants, Mr. Lucky’s and Brick’d plus the Bristol Bar. “The feedback has been amazing, but we haven’t promoted our restaurants. We wanted our team to get really good at what they are doing, build the consistency and make sure our ticket times were not too long. We’re getting to the point where things are more consistent and more timely. Feedback from our guests is great,” Evangelista said.

She noted the outside of the former Bristol Mall looks the same as it always has. However, inside, demolition and asbestos have been completed and construction of the permanent venue will start soon. “We’re finalizing some of the plans but everything is on track and we’re still aiming for May 2024,” Evangelista said.
