888 Casino Launches New System in New Jersey

888 casino, the online casino platform from 888 Holdings, has launched a new platform in the competitive New Jersey market that significantly increases the amount of casino games offered by a brand mostly associated with online poker.

The new platform is named Orbit and has been offered in the UK market since May 2018. The platform offers an “enhanced user experience” and several new games.

“The Orbit platform is without doubt one of 888’s most significant product innovations in recent years and supports our continued focus on delivering the safest, most exciting and most enjoyable online gaming experience possible for our players across regulated markets globally,” said Itai Pazner, CEO of 888 Holdings in a press release.

The company has reported that conversion rates for first-time depositors have increased 76 percent since Orbit’s soft launch in the U.K.

The move comes in a New jersey market that is currently seeing explosive growth in both online gambling revenue and online sports betting. The state’s Division of Gaming Enforcement reported June online casino revenue of just under $36.3 million, up more than 70 percent over 2018.

The Orbit platform will add 35 new games that 888 developed in-house and increase slots, table and live dealer games at the site.

The company also plans to upgrade its online poker interface, which now is live in New Jersey, Delaware and Nevada and will soon launch in Pennsylvania.

Rivers Barred from DFS Court Battle in N.Y.

New York’s Rivers Casino & Resort has been rebuffed in a court bid to have daily fantasy sports declared illegal under the state Constitution.

DFS was authorized in 2016 by an agreement between its proponents in the legislature and Governor Andrew Cuomo that the games are skill-based and therefore don’t constitute an expansion of gambling, which would require a constitutional amendment.

That view has been challenged, however, and last year, opponents won a ruling in Supreme Court, the first level of New York’s court system, that DFS does in fact violate the constitutional requirement.

The state Attorney General’s Office has appealed that ruling and oral arguments are scheduled to be heard later this year.

As a potential DFS competitor in New York’s nascent sports betting market, the Schenectady operator wants to join that challenge in hopes of obtaining a definitive ruling outlawing it. As one of Rivers’ attorneys has stated, “Whether (daily fantasy sports) is viewed as a game of skill or chance it is still unauthorized ‘gambling’ as that term is used in the constitution.”

Rivers’ argument has been blocked, however, under a new Appellate Division ruling that the casino lacks the legal standing to make it.

“The only time that I remember seeing a New York appellate court turn away a proposed amicus brief was when the proposed amicus had a direct financial interest in the outcome of the appeal,” said Albany attorney Rob Rosborough.

Which may be the court’s finding in Rivers’ case, he said, if the judges believed its interest in the outcome was purely based on economics.

Penn National Enters Multiple iGaming Partnerships

Penn Interactive Ventures, a wholly-owned subsidiary of U.S. gaming and racetrack operator Penn National Gaming, announced last week that it has jumped into the mobile sports betting and iGaming arenas, inking multi-year deals with four sports wagering operators.

The deals with DraftKings, PointsBet, theScore and The Stars Group give those companies the ability to own and operate “skins” under their own brands in the markets where Penn National operates, offering a cornucopia of real-money online sports betting, poker and casino games.

Penn National has 41 casinos in 19 U.S. states, including eight jurisdictions with legal sports betting and others that are considering legal wagers or have legislation in the wings. The deal doesn’t include Penn National’s retail sportsbooks, which are run by William Hill US.

In a July 31 news release, Jon Kaplowitz, Penn National’s senior vice president of interactive gaming, stated, “We’re pleased to be providing the top names in sports betting, iGaming and poker access to our company’s non-primary licenses to conduct these operations in exchange for a combination of upfront cash and equity, one-time market access fees and ongoing revenue sharing.”

According to Penn National, operators will have the option to launch a first, second or third skin in the markets where the company has a presence subject to license availability, state law and regulatory approvals in those markets.

“Sports betting represents an exciting new growth opportunity for Penn National,” Kaplowitz continued. “Our skin agreements will help fund the cost of launching and maintaining our primary sports betting and iGaming operations, both by way of the upfront consideration and the long-term revenue-sharing arrangements, which are consistent with industry standards and subject to minimum guarantees.

“By controlling our front-end product and relying upon our new partnership with Kambi for managed-trading services, we can create a lasting and differentiated online and retail product experience for our customers,” Kaplowitz stated.

He pointed to the company’s recent iGaming launch in Pennsylvania, where the company was first in line to accept legal wagers. “We will be launching our first in-house retail sportsbooks at our Iowa and Indiana properties in the coming weeks,” he added.

The agreements with the four companies include terms ranging from 10 years with the option for a 10-year extension (DraftKings) to 20 years for the others.

Kambi is the technology provider of choice for sports betting in states with active sports betting legislation and will integrate its platform ahead of a roll-out in these jurisdictions, according to CDC Gaming Reports.

“Kambi’s strategy has always been to partner with tier one operators, particularly those that share our vision and passion for sports and sports wagering,” Kambi CEO Kristian Nylén said of the deal. “In Penn National, we have found an ideal partner—one that is not only passionate about providing high-quality sports wagering experiences to its customers, but a company that adheres to the highest level of ethical business standards.

“It’s an honor for Kambi to be working with an organization of the size and stature of Penn National, and we look forward to helping them become a national leader in the U.S. sports betting market in the coming years.”

Telsey Advisory Group said the new partnerships are a plus for Penn National, but “might be a bigger negative for other operators.”

“We think they will make it more difficult for other more traditional operators such as MGM to be able to take share,” the group cautioned. “A major component of the transaction will also depend on the revenue share and the success of the partners in each of the states.”

Sports Betting Elbows iPoker Legalization in California

The heat over sports betting appears to have shoved aside any interest in legalizing online poker in California.

Efforts to legalize iPoker in the Golden State are left cooling on the side on the road. Nevertheless, the state represents a prize that is hard for iPoker advocates to ignore for long. That includes a population of 40 million, and, as boosters of the state never fail to brag, the fifth largest economy in the world.

Online Poker Report quoted H2 Gambling Capital, which estimated that illegal offshore online casino generates about $200 million annually. That’s money unavailable to be taxed by California regulators. It’s also unavailable for legal card clubs and Indian casinos to tap.

Proponents of legalization point to the fact that, six years after legalizing online gaming, New Jersey will probably rake in $525 million in iGaming revenue. California, they say, would have an online poker market conservatively estimated as $100 million a year.

Besides paying state gaming taxes, licenses would also be a sure money-maker for the state, they say—not to mention jobs created, money spent on advertising and the leveraging effects on existing brick-and-mortar casinos.

Before the U.S. Supreme Court’s May 2018 decision to strike down the Professional and Amateur Sports Protection Act and end the federal ban on sports gaming, much political capital was being spent in Sacramento on legalizing online gaming. Those same politicians quickly changed their focus to sportsbook.

There are several reasons for this. One is that virtually no gaming legislation can be introduced in the Golden State without the support of the larger Indian casinos. However, the gaming tribes are split over online poker, which makes it hard to reach a consensus. In addition, the state has a unique bifurcated regulatory gaming framework, with some regulatory oversight under the governor, and other oversight under the attorney general, who are independently elected officials.

A former California gaming regulator, Richard Schuetz, made a remark on Twitter that was quoted by Online Poker Report: “People don’t understand how much legal gambling takes place in California and how big the state is. During the iPoker debates, they would promise millions in tax revenues. It was what we called ‘budget dust.’”

Which means that big can sometimes be the enemy of the good, or the profitable.

Betdaq Launches Sportsbook

Betdaq has launched a fixed-odds sportsbook to complement its 2 percent exchange and online casino, the company announced.

The sportsbook will be backed by a multi-channel marketing campaign that includes PR and social media activities with ex-England footballer Glen Johnson. It also offers a shared Betdaq wallet, best odds guaranteed, full and partial cash out, live streaming and in-play betting with visualizations, according to a press release.

The platform was developed in conjunction with Betdaq’s exchange platform provider gbet, while utilizing pricing input and expertise from parent company GVC Holdings.

The development follows strong growth over the past 18 months since Betdaq first switched to a permanently low 2% commission on all exchange markets and bets, the release said.

“Launching the Betdaq sportsbook is the realization of a key strategic aim,” said Betdaq Managing Director Shane McLaughlin in the release. “The consolidated Betdaq exchange-sportsbook-casino demonstrates our strength as part of GVC and means customers can enjoy an improved experience. The exchange remains our central product and the complementary introduction of the sportsbook allows us to attract and convert new players.”

New Zealand Considering Credit Card Ban for Online Gambling

New Zealand is considering a ban on credit card use for online gambling as its largest casino operator prepares to launch a new online site through Malta.

SkyCity, New Zealand’s major casino operator, has announced plans for the site, prompting the Department of Internal Affairs, the industry regulator, to review the country’s gambling laws to “ensure that they are fit for purpose,” a spokesman told CDC Gaming Reports.

New Zealanders are legally allowed to gamble at offshore casinos and SkyCity estimates up to $110 million is bet from the country each year. Overall, however, $1.6 billion is bet each year in all forms of gambling including online gambling through Lotto and the TAB.

SkyCity said would comply with any legislative requirements.

Encore Boston Meets Expectations

The $2.6 billion Encore Boston Harbor in Everett, Massachusetts, the largest commercial casino on the East Coast, opened its doors on June 23. The Massachusetts Gaming Commission reports that Encore took in $16.79 million in revenue its first week, which translates to $2 million a day, compared to $20 for the entire month at MGM Springfield and $13.5 for June at Plainridge Park.

Analysts are paying close attention to room rates, which can provide a clue to how well a casino is doing. They note that average daily rates have hovered around $690 in July and are increasing to $706 in August. That runs counter to Boston ADRs, which typically decrease from July to August.

About half of the Encore’s revenues came from its 3,158 slot machines, which generated a 90.25 percent return on wagers. The facility’s 242 gaming tables collected another $7.67 million in the first eight days.

The first week’s revenues, if extrapolated to annual revenue, would produce $870 million in revenue. But that’s highly unlikely to happen. Nevertheless, the results indicate that it is entirely doable to achieve Wynn Resorts’ announced goal of $1 billion and EBITDA of $275 million by the third year of operation.

As the late H. Ross Perot might have put it, the “sucking sound” heard in New England was the profits from Indian casinos in Connecticut being Hoovered in the direction of the Encore.

Foxwoods’ slots revenue declined 11.8 percent in June and the Mohegan Sun’s revenues fell 5 percent. Closer to home, the Plainridge Park slots parlor, located 35 miles away in Plainville, saw its profits fall 8.86 percent.

June also represented the worst revenue month for MGM Springfield: it was the second month since it opened that the resort didn’t earn a minimum of $21 million from gaming.

On the other hand, Encore generated new revenues completely disconnected from other casinos, making casino revenues statewide grow 238.44 percent the first week of operations.

In reaction to the smooth launch, Encore Boston Harbor President Robert DeSalvio told WGBH Great Boston, “So far, so good.” He added, “However, I will tell you that it takes a while to ramp up and build these properties up to full potential—you have to build a database—so for us, there’s an expectation that it doesn’t come automatically, but it will come over time.”

Boston basketball legend Larry Bird is the spokesman for the newly opened casino. In a series of ads, he promotes the luxury casino and hotel with his erstwhile rival Magic Johnson.

The two hoops greats clashed numerous times in the 1980s, when Bird played for the Celtics and Johnson was a star for the Lakers. But they appear together in the TV ads along with the musical group the Chainsmokers, showcasing the Wynn property’s unique collection of fine arts, great food and luxury appointments.


Class Action Lawsuit

Meanwhile, a class-action lawsuit has been filed against the Encore alleging that it’s cheating blackjack players and “willfully and intentionally” withholding slot winnings. The lawsuit was filed in Middlesex County Superior Court early last week.

The court papers were filed by the lawyer Joshua N. Garick on behalf of the plaintiffs, New York resident Richard Schuster. The suit alleges that the Encore paid players odds of 6 to 5 when they drew a blackjack, i.e. 21. The suit contends that state regulations mandate that blackjack should be paid at 3 to 2 odds. In an example given by the lawsuit, a wager of $50 should win $75 under Bay State law. However, it says, the Encore actually would pay $60. However, state regulations actually permit the 6-5 blackjack payout.

The lawsuit also alleges that the casino further bends the odds in its own direction by only paying out slots winnings by whole dollars, rounding down on the ticket redemption machine.

The Massachusetts Gaming Commission initially issued a statement saying that “since opening, Encore Boston Harbor (has followed) the Massachusetts Gaming Commission regulations for blackjack payouts.”

It followed this statement a few days later with a statement that a preliminary investigation showed that the casino wasn’t cheating players.

Regarding the lawsuit’s contention that the casino only pays out slot winnings in round numbers, the MGC noted that the slots don’t dispense coins, and to collect winnings that are not rounded up or down, players must cash in at the casino’s cashier.

The commission suggested better signage to advise customers of this fact. In response, the Encore says it may add redemption machines that dispense coins, as the Plainridge Park and MGM Springfield casinos do.

Pushback on Payment Claims

Reacting to Boston Herald and Telegram & Gazette accounts of complaints by Coghlin Electrical Contractors Inc. that it’s owed $30 million in change orders for work it did on the Encore Boston Harbor, the overall contractor for the project, Suffolk Construction, strongly disputed Coghlin’s claims last week.

Suffolk accused Coghlin of engaging in “unfair business practices.” Linda Dorcena Forry, vice president of diversity, inclusion and community for Suffolk, issued this statement: “Despite Suffolk’s numerous requests for information over several months, Coghlin has consistently failed to provide supporting documentation for a majority of its remaining claims, as required by the subcontract Coghlin signed.”

She added, “In fact, Coghlin recently and unexpectedly added millions of dollars to its list of claims without providing any meaningful documentation to substantiate those claims. We have learned that this is not the first project on which Coghlin has engaged in these unfair business practices.”

Coghlin owner and president Sue Mailman countered that the claims could not be calculated until the project was over. She said in a statement, “The recent additions to our change order requests are claims which can never be calculated until the project is done.” Mailman added “Suffolk forced Coghlin to sign documents to get paid. Suffolk nor Wynn did not let Coghlin bill for additional work. Now that Suffolk has settled with Wynn and Wynn has the doors open, Coghlin is not being paid by Suffolk. Suffolk and Wynn knew to expect claims.”

Plainridge Park Casino

Meanwhile, legislators representing the Bay State’s southeast are advocating that the Plainridge Park Casino, which was always envisioned as a slots parlor, be allowed to add table games.

Rep. Shawn Dooley has filed a bill that would allow but not require MGC to allow the slots casino to add up to 30 tables and 250 slot machines. The bill touts the casino’s “employment and revenue benefits to the commonwealth, community, and surrounding communities.”

Speaking of the impact the casino has had on its host community and environs, Rep. Elizabeth Poirer told the Economic Development Committee, “There is no bad news. It’s good news all the way around.” North Attleboro town councilor Keith Lapointe said, “All we’re seeing right now are benefits.”

Referring to the hot competitive gaming environment in New England, Rep. Jeff Roy described “a community which borders the state of Rhode Island; just 10 miles away we have Twin River and about 26 miles away we have the Tiverton casino and these casinos were put in place to directly compete with Plainridge. Neither of them had the table games when Plainridge was given its slot license, but they now have those in place and they are directly competing for Massachusetts dollars.”

Foxwoods Appoints John James as New President/CEO

John James, a veteran with more than 25 years of experience in tribal gaming in California, Florida and Arizona has been named CEO and president of Connecticut’s Foxwoods Resort Casino.

James comes to the job from his current position as CEO of Morongo Casino Resort & Spa in Cabazon, California. He will step into his new role on August 12. He succeeds Felix D. Rappaport, who died in June 2018 and = was succeeded by interim Chairman and CEO Rodney Butler.

Butler, who will step back into his role as tribal chairman of the Mashantucket Pequot Tribe, praised the incoming leader: “Over the past decade, Foxwoods transformed the traditional gaming model through a relentless pursuit of guest-first experiences resulting in the only true all-encompassing resort destination. With his proven track record for innovation, John is the right leader to continue that commitment to our guests, fulfill our vision and ignite our passion for delivering a resort that excites and surprises. James came to Morongo from Gila River Gaming Enterprises, where as CEO he led the tribe’s three casinos. Under his leadership, the casino achieved record profitability. He also was chief executive at Seminole Gaming Inc. and Pechanga Resort and Casino.

James is a Cleveland, Ohio native and graduated from the University of Nevada, Reno.

New Jersey Changes Requirements for Government Change in Atlantic City

A new law in New Jersey requires a larger percentage of names on a petition to force a referendum on changing a municipality’s form of government and comes as a petition drive to do just that is underway in Atlantic City.

Lt. Governor Sheila Oliver, serving as acting state chief executive while Gov. Phil Murphy was out of the state, signed a bill that raises the percentage of valid signatures needed to submit a petition under the state’s laws from 10 percent of votes cast in the last General Assembly election to 25 percent.

For the Atlantic City petition drive, that raises the number of signatures needed to force a referendum on changing the government form to about 2,472 signatures as opposed to 989 under the previous structure, according to a report in the Press of Atlantic City.

The petition drive is being conducted by Unite Here of Local 54, the city’s largest casino workers union. Local President Bob McDevitt said the increase will not stop efforts to make the change.

“It doesn’t change our plan,” McDevitt told the Press. “We were already going to get 3,000 signatures anyway.”

The union and other supporters want the city to change from an elected mayor and council to a city manager form, which under New Jersey law would put the city under the control of an elected committee which would hire a professional city manager.

A majority of the Atlantic City Council, the Atlantic City Democratic Committee, Atlantic County’s two state Assembly representatives, Atlantic City’s freeholder representative, the city’s police and fire union presidents, and the chair of the state Legislative Black Caucus have all come out in opposition to the change in government proposal.

The state bill was not in response to Atlantic City’s petition drive, but to moves to change the government form in other state municipalities. Supporters said they believed the 10 percent threshold was simply too low.

In another story, the state Casino Reinvestment Development Authority gave preliminary approval to spending $10.4 million to renovate parts of Jim Whelan Boardwalk Hall for the Atlantic City school board to use rent-free for its offices.

According to the Press, some CRDA board members questioned the cost and appropriateness of the plan and the board will do more research and hold a public hearing before a final board vote.

If the project moves forward, it would save the city’s Board of Education about $650,000 a year the school board now pays in rent for its offices at 1300 Atlantic Ave.

Hossein Ensan Wins $10 Million WSOP Main Event

The World Series of Poker Mani Event came down to an international matchup as Germany’s Hossein Ensan won the $10 million top prize after a heads-up showdown with Italy’s Dario Sammartino.

“It was like an Italy-Germany final,” the 32-year-old Sammartino told the Las Vegas Review Journal. “It’s really fun for poker. We need this.”

Ensan topped a field of 8,569 to claim the $10 million first-place prize.

“This is the best feeling I have in all my life. I can’t believe it,” said Ensan, 55, a native of Iran. “I must go to sleep and wake up. Then I know I have bracelet. Maybe it’s a dream. I don’t know.”

Sammartino, from Naples, took home $6 million for second place.

According to the Journal, Ensan is the first champion in the 50-year history of the Main Event to win the final hand on a pair of kings. Sammartino had a straight and flush draw after the turn and went all-in for 140 million in chips. Ensan called with pocket kings. A queen of clubs on the river was no help to Sammartino.

“Dario is a friend of mine. He’s a big name and a very good player,” Ensan said. “Shorthanded, you need cards, you need hands and for sure, luck. And luck and hands were on my side. Otherwise, I was second. I lost a lot of my chips.”

In another matter, player Chris Moneymaker and David Oppenheim were named to the WSOP’s Poker Hall of Fame.

Money maker started a major poker boom when he won the 2003 WSOP Main Event as an amateur after buying in through an $86 online satellite.

Oppenheim, 46, a cash game professional who resides in Calabasas, California, has earned almost $2 million during his 25-year professional career at the WSOP.

New Indiana Casino to Become Hard Rock

Spectacle Entertainment recently shut down the Majestic Star Hotel in Gary, Indiana. The venue was built in 1998 by the Trump Organization. Jahnae Erpenbach, Spectacle executive vice president of operations and Majestic Star Casino general manager, said the hotel was closed due to steadily declining occupancy and would have required immediate, significant renovations to bring it up to Spectacle’s standards.

Also, Erpenbach noted the Majestic Star casinos will relocate in the next few years to a new, land-based facility adjacent to the Borman Expressway, which officials recently announced will be managed by Hard Rock International

“Closing the hotel will allow us to invest all of our available funds to enhance the existing casinos,” Erpenbach said, including adding new slot machines, table games and sports wagering. The venue also will reconstruct its original, impressive entrance. “Bringing back the popular porte-cochere entrance will provide a beautifully lighted area for our valet services, a warm welcome for guests upon arrival and direct access to the Harbor View Buffet and Lakeshore Lounge,” Erpenbach said.

Meanwhile, Spectacle Entertainment and Hard Rock International announced the estimated cost of the new Gary venue will increase by one-third to $400 million with the addition of numerous restaurants and bars, a Hard Rock Cafe and a Hard Rock Live concert venue.

Hard Rock International Chairman and Chief Executive Officer Jim Allen said, “Hard Rock is excited to partner with Spectacle Entertainment to create the first land-based gaming destination, bringing our world-class brand of entertainment to Northwest Indiana and the greater Chicago area.” Spectacle Chairman and Chief Executive Officer Rod Ratcliff added, “We’re confident this $400 million investment will serve as a significant catalyst for the continued economic revitalization of Northwest Indiana and the city of Gary.”

Ratcliff said the development will create 1,000 temporary construction jobs and 2,000 permanent jobs—more than double the 800 current employees at the two Majestic Star casino boats.

Spectacle Vice President Greg Gibson said the Hard Rock partnership will enhance the company’s bid for the new Terre Haute casino license. “Hard Rock and Spectacle Entertainment’s additional partnership to compete for the Terre Haute site would provide more stability for the economy and workforce in central Indiana, including more than 500 much-needed job opportunities.”

The Indiana General Assembly approved a casino in Terre Haute pending the outcome of the November 5 referendum in Vigo County. If voters approve a casino, the Indiana Gaming Commission would select the operator from all qualified applicants, including Spectacle and possibly Full House Resorts. A $100 million investment would be required.

Terre Haute business leaders recently formed the Advance West Central Indiana Political Action Committee to “inform and educate the community” about the benefits of a casino, said committee Chairman John Collett. He said the PAC hasn’t set a firm fundraising goal but it will take six figures to “do it the right way.”

Sands Bethlehem Now Wind Creek

Alabama’s Poarch Band of Creek Indians, which closed last month on the purchase of Pennsylvania’s Sands Casino Resort Bethlehem, has officially renamed the casino-hotel Wind Creek Bethlehem. In a nod to the original owner and builder, the Sands’ event center has been renamed Sands Bethlehem Event Center.

Wind Creek Hospitality, the hotel/entertainment branch of the Poarch Creek tribe, bought the property from Las Vegas Sands Corp. for $1.3 billion, in the largest acquisition in the tribe’s history. Wind Creek is investing another $340 million to upgrade and expand the property, including construction of a 300-room hotel tower, a 300,000-square-foot adventure and water park at the existing No. 2 Machine Shop Bethlehem Steel Site and a 400-to-450-room hotel adjacent to the adventure park.
