Goodbye, Harrah’s Reno

The downtown Reno gambling hall that launched the Harrah’s empire is being sold for conversion into a mixed-use development that might include a hotel, but not a casino.

VICI Properties, the Caesars Entertainment REIT that owns Harrah’s Reno Hotel and Casino, said it’s getting $50 million for the Virginia Street landmark. The buyer, an investment group fronted by an entity called Reno City Center LLC, will maintain it as a casino under a short-term lease with Caesars that will terminate later this year.

The 82-year-old casino and its 940-room hotel then will close, although a hotel may reopen at the site at a future date, according to news reports.

VICI and Caesars will split the $50 million 75-25.

“We recognize the long legacy of Harrah’s in Reno, where the brand began, and our role in the community,” the two said in a joint statement. “We are pleased the buyer is committed to the community and supports the redevelopment of this wonderful asset.”

It’s reported that the sale was prompted by Caesars’ pending $17.3 billion merger with Eldorado Resorts, which similarly was founded in the Northern Nevada city, is headquartered there, still owns three downtown casinos, and might have faced an antitrust issue.

It also aligns with Eldorado’s desire, when the merger closes, to sell off the portions of the combined portfolio it considers non-core to pay down debt from the merger and cut around $500 million in costs.

Eldorado is engaged currently in separate transactions to unload six of its own casinos in four states and is expected to reach a deal in the weeks ahead to sell a resort in South Lake Tahoe. More sales are expected to follow.

Caesars, meanwhile, is busily transferring casinos to VICI under a number of previously agreed deals. VICI, which was spun off as a separately traded REIT in the Caesars bankruptcy reorganization in 2017, already owns more than half the casino giant’s 38-property U.S. portfolio.

Harrah’s Reno dates back to 1937, when California businessman William Fisk “Bill” Harrah expanded his Virginia Street bingo operation into a casino. He steadily grew it over the decades, with purchases of adjacent land and casinos and the first of two high-rise hotels.

After his death in 1978, his company, which by then included casino hotels in Las Vegas and Lake Tahoe, came under the ownership of the Memphis-based Holiday Inn Corp., which expanded into gaming in Atlantic City in the ’80s and plunged into the industry’s rapid cross-country expansion in the early ‘90s. Holiday Inn later spun off the casino portfolio, and Harrah’s Entertainment, one of the largest and most successful publicly traded corporations in casino history, was born.

Things began to change in the new century, however, as jurisdictional expansion largely played itself out and same-store growth got harder to come by in increasingly crowded markets. M&A became the name of the game. In 2005, Harrah’s spent $9 billion to acquire an amalgam of operators that included Bally’s and Caesars, retaining the Harrah’s brand with Caesars Entertainment as the new holding company and with the addition of a major presence on the Las Vegas Strip. Three years later, on the eve of the Great Recession, the holding company was acquired by private equity giants Apollo Global Management and TPC Capital in a $30 billion leveraged buyout that buried it under a mountain of debt from which it was ultimately forced to seek the shelter of Chapter 11.

Restructuring the behemoth’s finances took two and a half years, and no sooner was it accomplished, late in 2017, than the company came into the sights of corporate raider Carl Icahn. Icahn began buying up stock in 2018, and by the following spring, he’d amassed a controlling stake. He immediately pushed for a sale. By June, the merger with Eldorado was concluded, a new giant with $15.5 billion of combined debt was created, and Icahn pocketed a reported 50 percent profit on his holding.

As for the employees of Harrah’s Reno, they’re looking at something rather less pleasant, although Caesars fixed a cheery face on it in a statement attributed to CEO Tony Rodio and released simultaneously with the announcement of the sale.

“We have worked closely with the buyer to provide a reasonable closure plan that allows our great staff in Reno ample time to secure their next jobs,” he said, “including priority consideration for relevant openings at our other properties in Nevada, including Lake Tahoe and Las Vegas.”

IGT, Rhode Island Operator Making Peace?

International Game Technology and Twin River Worldwide Holdings (TRWH) last week confirmed that they are in talks to end the fight over Rhode Island Governor Gina Raimondo’s proposal to award a no-bid 20-year Lottery contract to IGT.

The two companies have been locked in verbal combat for months over the $1 billion contract, which the governor first proposed and Twin River challenged once it reached the legislature.

Recently, a Providence Journal reporter saw executives of the two companies talking together outside the governor’s policy office. They were IGT’s Chief Operating Officer Jay Gendron and Twin River Executive Vice President Marc Crisafulli, who runs the company’s Rhode Island casinos. They declined to comment on why they were there, but later, Senate President Dominick Ruggerio confirmed that he had met with the two and was hopeful of a deal.

IGT spokesman Bill Fischer told a reporter, “I can confirm that IGT has been in ongoing discussions with Twin River. I do not have any substantive updates for you on that front this evening.” Twin River issued a similar statement.

The governor’s office was silent on a possible rapprochement. Raimondo put together the no-bid, 20-year $1 billion Lottery contract and presented it to the legislature, only to see a considerable blowback led by Twin River, hotly contended House and Senate Finance Committee hearings and a bipartisan demand for a study to see if the deal made sense for the state.

Twin River has asked for the chance to bid on the contract, and offered a deal that was more lucrative than the one IGT signed. TRWH is mainly concerned about a provision that gives IGT the right to supply 85 percent of the slots used by the two Twin River casinos. TRWH claims that machines from other manufacturers are better performers.

IGT is skeptical about Twin River’s ability to manage the Lottery contract. It also reminded the state that if it loses the contract, 1,000 IGT employees working in Rhode Island will be unemployed.

Last month IGT Chairman Robert Vincent told the Journal, “We look forward to a continuation of the legislative review process. It is important to note that our internal planning process to consolidate operations continues to intensify. We hope that the legislation will be acted on in a timely manner when the legislature reconvenes.”

Meanwhile, the independent study of the IGT proposal that the legislature commissioned is expected to be delivered next week.

Wynn to Nevada Regulators: See You In Court

Is deposed casino magnate Steve Wynn still subject to the authority of Nevada gaming regulators? The question has enough at stake—for both sides—that it will wind up before the Nevada Supreme Court.

The state Gaming Control Board has petitioned gaming commissioners to have Wynn formally declared “unsuitable to be associated with a gaming enterprise or the gaming industry as a whole” on the basis of widespread accusations that for years he preyed on female employees of Wynn Resorts for sexual favors. The declaration effectively would bar Wynn from ever obtaining a casino license in Nevada, and probably nowhere else in the United States.

Last month, the commission, the final word on regulation in the state, held a hearing on that petition and voted 5-0 to approve it.

Commissioner Steven Cohen, a Las Vegas attorney, said allowing Wynn to simply “walk away” could lead to any “bad actor” escaping the purview of gaming regulators.

For nearly half a century, Wynn reigned over Nevada’s largest industry, and much of its politics as well. He refuses to acknowledge the state’s authority to make the declaration, with all that it implies, in what has shaped up a final tussle over power.

Wynn resigned as chairman and CEO of the publicly traded company he founded shortly after the accusations were first uncovered in a 2018 report in the Wall Street Journal. He denied the charges and is suing some of the individuals who made them, but a Control Board investigation that concluded last fall found enough merit in them to fine Wynn Resorts a record $20 million for failing to act on years of complaints from the billionaire’s reputed victims. The company later agreed to a $41 million settlement with shareholders, $20 million of which was paid by Wynn.

By that point, he had already sold off his sizable financial interest in the company and had surrendered his gaming license as part of the divestiture. He claims this ended the state’s regulatory jurisdiction over him, and he did not comply with a subpoena to appear before the board during its investigation.

Attorney Don Campbell, who represented Wynn at the commission hearing, said his client “does not have a gaming license” and told CDC Gaming Reports Wynn “has no intention (in Nevada) nor anywhere else in the world to re-enter gaming. None.”

The Gaming Control Board, however, claims the state’s authority over him still prevails, and his license still exists under what it terms an “administrative hold” placed on its surrender.

“The Gaming Control Board nor the Nevada Gaming Commission have done nothing to release Mr. Wynn from jurisdiction,” Cohen said.

At the commission hearing, Steve Shevorski, chief litigation counsel for the Nevada Attorney General’s Office, argued on behalf of the Gaming Control Board that the commission still has “absolute power in this matter.”

Campbell said his next move will be an appeal in Clark County’s District Court, and will go to the Supreme Court if necessary.

Vermont Looks at Mobile-Only Sportsbooks

Vermont could become the only state to offer mobile sportsbooks—only mobile sportsbooks—because it has no gaming at all other than the state lottery.

Two state senators have introduced a bill that would legalize sports betting. If the bill is adopted, mobile sports betting would go live by the middle of this year.

Senator Dick Sears, co-authors of S 213 with Senator Michael Sirotkin, explained to GGB News why the bill only provides for mobile sports betting.

“We don’t really have any racetracks or casinos or off-track betting like some states,” he said. “I think it’s the only way you could do it.”

He said the bill would call for the state’s Department of Liquor & Lottery to contract with a provider such as DraftKings or FanDuel.

The main reason he sponsored the bill, said Sears, is to bring an illegal activity into the light of day. “The amount of betting that goes along illegally or around the country or in Vermont is so high that it’s an opportunity to put some parameters around it and obviously avoid having people go to new Hampshire to place a bet,” said the senator. “It’s also to curb illegal betting.”

New Hampshire has been successful launching sports betting, with almost $3.5 million bet in the first week, according to Governor Chris Sununu.

The sports betting industry approached Sears about it. “But I’ve

been thinking about it for quite a while as I saw Massachusetts, Rhode Island and other new England states begin talking about it,” he said.

The tax rate would be determined later as the bill is taken up by Senator Michael Sirotkin, chairman of the Committee on Economic Development, Housing and General Affairs. The bill does call for a license fee of $10,000 for both operators and suppliers.

“I’m thinking 10 percent taxation rate,” said Sears, adding that a lot of details will be determined later. “We went through a lot of decision-making. I didn’t want to do college betting, but I was convinced by others that there is so much college betting done that it ought to be part of it.”

He sees the state getting taxes from sports betting, “but that’s not the huge factor. For me, the factor is to give Vermont some control over what goes on in its state.”

Still, there could be a fight. “Anything gambling is controversial in this legislature,” said Sears. “We hope that people will appreciate the reality of what’s happening in the real world.”

The bill makes no provision for the treatment of gambling addiction, and Brianne M. Doura-Schawohl, legislative director of the National Council on Problem Gambling (NCPG), would like to do something about that.

Doura-Schawohl has read the draft bill, and told GGB News that she has concerns. “The council is neutral on legalized gambling. What we are going to say is if there is an approval, a consideration is made for problem and responsible gambling. Although we can’t get rid of it, there are many things that legislators and operators can do to mitigate risks and reduce the harm of gambling.

“We call on all legislators to incorporate into the bill a protected funding stream that is solely earmarked for problem gambling services, inclusive of research, prevention, intervention-treatment and recovery,” she said.

Doura-Schawohl spoke recently in San Diego at the National Council of Legislators from Gaming States (NCLGS), where she declared that all those who profit from gaming bear the responsibility to fund problem gaming treatment.

“Anyone who benefits really needs to be at the table,” she told GGB News. “Anytime there is a new form of legalized gambling brought into a state, subsequently there will be an increase in problems. What can we do to be proactive? States like Vermont that have poor infrastructure for dealing with problem gambling. will be struggling more,” she said.

The entire bill has one mention of problem gambling, she said, a passage that reads, “the promotion of social responsibility, responsible gaming, and the display of information regarding how an individual may obtain assistance for a gambling problem.”

“There is no funding allocated,” she said.

According to the 2016 Survey of Problem Gambling Services in the United States, she noted, “An estimated 2.2 percent of Vermont adults are believed to manifest a gambling problem.” Vermont has a population of about 600,000. Currently, the lottery allocates $150,000 to problem gaming.

“If this bill passes, there isn’t any money allocated to fund a help line, make sure there are clinicians to help people, and there isn’t any money for recovery and to keep people safe,” said Doura-Schawohl. “It’s really a time in this nation for legislators to examine what they have neglected so long, and to be aggressive in terms of public welfare. They can create a fund that all these things feed into to go into these initiatives. Not one entity can do this alone. It’s going to take collaboration. It needs to be responsible, comprehensive and it has to be adopted to meet the needs of the state. If it’s too rigid, it won’t be effective.”

Verizon Eyes Sports Betting and Media Content

Last November, Verizon Communications entered the sports betting world when it partnered with MGM Resorts International in New Jersey. The company, through Yahoo Sports, expects to expand its MGM relationship to at least five states in 2020.

The phone company plans hinge on sorting out the various state policies and platforms, Verizon Media Chief Executive Officer Guru Gowrappan told Bloomberg News at the CES electronics show in Las Vegas.

Companies like DraftKings Inc. and FanDuel Inc. dominate the sports betting field, but with 16 million active users on Yahoo Sports and a BetMGM sportsbook in New Jersey, Gowrappan said there’s a foundation for a larger betting network.

“It’s an important priority for us, and a huge bet for us,” he said.

Verizon, which ranks as the largest U.S. wireless carrier, has relatively few side businesses, and has been focused almost completely on the rollout of 5G service. Gowrappan spent last year restructuring the media business, previously called Oath. He calls this year a building period.

In August, Verizon sold blogging platform Tumblr as part of a broader strategy of moving away from user-generated content and social media. Gowrappan said additional asset sales are unlikely, but there could be opportunities in content or advertising.

Verizon Media may also involve itself in the presidential campaign. The company has a site that consists of candidate profiles and 90-second elevator pitches from each candidates.

“We’ve launched an election hub, which focuses on bringing all our content together, creating an election experience for consumers who are going to vote in 2020,” Gowrappan said.

NY’s Addabbo Pushes for Mobile Sports Betting this Year

As 2020 dawned, New York state Senator Joseph Addabbo Jr. continued his push for mobile sports betting. The Senate Racing, Gaming and Wagering Committee he chairs passed sports betting bill S 17 on January 13 in the committee’s first meeting of the year.

According to LegalSportsReport.com, the Senate approved S 17 last June, but the Assembly never brought it up for a vote after getting word that Governor Andrew Cuomo would veto the legislation. The bill carried over unchanged to the second year of New York’s two-year session.

Less than five minutes into the hearing Monday morning, the bill had unanimous approval after quick comments from members, then moved to the Senate Finance Committee.

Addabbo sees the quick start as a way to capitalize on momentum for the impending budget process, which begins this month. He hopes Cuomo will include mobile casino expansion and sports betting in the budget. But the governor didn’t speak on either in his State of the State address earlier this month.

“Every time the governor spoke at the State of the State, I heard a cash register go off. (I) see the need for substantial revenue, which I believe mobile sports betting and the three unused commercial gaming licenses provide,” Addabbo said.

The budget process will continue until April 1, with discussions among the Senate, Assembly and executive office.

As passed by the Senate, S 17 could be better for the industry, but it’s not getting any improvements before moving out of committee this year.

Key components of the bill include:

  • An initial license fee of $12 million
  • Tax rate of 8.5 percent on retail sports betting and 12 percent on mobile
  • 20 percent of the handle on all wagers go to professional sports leagues as an integrity fee
  • One skin per casino
  • Casinos required to use official league data for in-play wagers if made available on “commercially reasonable terms” as determined by the New York Gaming Commission
  • Racetracks, off-track betting parlors, sports stadiums and arenas may partner with commercial casinos to offer sports betting through the mobile servers on their properties. Indian tribes also would need to partner with commercial casinos to offer mobile wagering

New England States Jump on Sports Betting

Think of Vermont, New Hampshire and Maine, and picturesque small towns come to mind—the kind of towns with Main Streets, and churches with steeples, and leaves of red and gold each autumn, and bets on the Patriots to win…

Yes, now you can add sports betting to the mix as Northern New England makes its move to solidify legalization, at least in two of the three states.

Vermont
In the Green Mountain State, Senators Dick Sears and Michael Sirotkin introduced a mobile-only sports betting bill this week that calls for license fees of $10,000 for both operators and suppliers. Other provisions include:

  • A 10 percent tax on gross sports revenues, paid monthly
  • A similar 10 percent tax on daily fantasy sports revenues put in place of the existing $5,000 annual fee
  • No stated limit on licenses/skins for online sports betting brands

Betting will be overseen by the state Board of Liquor and Lottery. If an operator loses money in a given month, the losses can offset future tax payments. The bill also codifies operators’ ability to lay off bets, saying the practice is permitted as long as both parties are transparent. If Bill S.213 succeeds, sports betting could go live by the middle of 2020.


New Hampshire

Look to neighboring New Hampshire as the reason for the current push. The Granite State, which went live with legal sports betting at the start of this year, saw nearly $3.5 million wagered in the first week, Governor Chris Sununu said in a tweet, with revenues benefitting public education.

In the first seven days, the state secured more than 16,000 new registrations in a state that has about 600,000 residents.

At the start of the year, New Hampshire went live with sports betting online through DraftKings Sportsbook, so will Massachusetts residents flock to the state to wager? Based on the initial results, New Hampshire could win the battle for Boston’s bettors. Pent-up demand appears to be very high.

DraftKings Sportsbook registered more than 6,000 players on the first day alone. Players bet more than $250,000, a significant amount for a Monday without an NFL game, according to LegalSportsReport.com. More than 16,200 players registered accounts as of January 6, according to InDepthNH.com.

The New Hampshire Lottery didn’t break out specifically how many of those accounts came from out of state, but the total from Massachusetts was “significant,” according to the Associated Press.

It seems natural that Boston-based DraftKings would seek the more than 4.5 million people in the metro area. Not only is it in their backyard, but it’s also more than three times larger than New Hampshire’s 1.4 million population.

New Hampshire represents just one potential competitor for Vermont. New Englanders also have the option to wager via retail or mobile means in Rhode Island as well. Vermont is one of the few states with no commercial gambling other than the lottery, which explains why the bill calls for mobile betting only.

“Early returns show that sports betting was absolutely the right bet for New Hampshire to make,” Sununu said. “The demand is there and New Hampshire is happy to serve as the region’s go-to destination for sports betting.”

New Hampshire represents just one potential competitor for Vermont. New Englanders also have the option to wager via retail or mobile means in Rhode Island as well. Vermont is one of the few states with no commercial gambling other than the lottery, which explains why the bill calls for mobile betting only.

Despite the New England Patriots getting knocked out in the first round of NFL playoffs, New Hampshire players are embracing sports betting, said Charlie McIntyre, executive director, New Hampshire Lottery. “In addition to players from New Hampshire, we have already seen a significant volume of players from out of state signing up to play. We look forward to building on our success, while offering our players a completely new way to experience the thrill of winning.”

New Hampshire state laws do not allow wagers to be placed on college teams from the state or college games taking place within state lines.

 

Maine

Sports betting could have been legal in Maine by January 10, but last Friday, Governor Janet Mills closed the book by vetoing a bill passed by the legislature in June.

Pro-sports betting lawmakers were optimistic Mills would simply let the bill become law without adding her signature. But on January 10, the Democratic governor shot down a bill that would have added the state to a growing number that allow gambling on sports events. Mills said she remains “unconvinced at this time that the majority of Maine people are ready to legalize, support, endorse and promote betting on competitive athletic events.”

Mills said the state is not sufficiently informed to OK legal sports wagers. According to the Associated Press, she said must put the brakes on illegal gambling and build a framework that protects young gamblers and the vulnerable.

The Maine bill would have allowed casino operators, off-track betting facilities, Indian tribes and harness race tracks to host sports betting. Lawmakers could potentially override the Mills veto.

 

Rhode Island

The Rhode Island Lottery launched its mobile sports betting product through IGT and William Hill at the beginning of the NFL season. Account registrations have been slow to grow, however, because of Rhode Island’s in-person registration requirement. As of December 2, Rhode Island had fewer than 8,000 people complete the registration process at one of Twin River‘s two casinos.

That pace could grow if a new trial program currently being tested by Twin River succeeds. The unidentified program was developed as the next evolution of the Rhode Island sports betting product to get more activations completed, a Twin River spokesperson said, without details.

Another Twist in the Wire Act

The Justice Department got an assist last week when Sheldon Adelson’s Coalition to Stop Internet Gambling (CSIG) filed an amicus brief in the appeal of the victory by the New Hampshire Lottery against the DOJ. The CSIG was joined by the National Association of Convenience Stores (NACS) in the brief, and argued semantics when it comes to the lower court’s decision to ignore a DOJ memo that overturned a previous memo that said the Wire Act only applies to sports betting, not online lottery sales or online gaming.

The brief argues that New Hampshire’s contention that the Wire Act does not apply to the state is specious, and says the word “whoever” can be widely applied to many entities, including the state.

Secondly, the brief says the use of the word “person” in the Wire Act applies again to many entities, even though in the past, person was meant to exclude states and jurisdictions.

With New Hampshire making this assertion, the state could conceivably sell lottery tickets to people in Georgia or allow someone from Kansas to access online slot games, according to the brief.

The brief points out that the Wire Act couldn’t have predicted that states might operate gambling entities since when the act was written in 1961, only Nevada had a legal gaming business and no states were involved in lottery sales.

New Hampshire has yet to respond to the DOJ’s appeal of the decision in District Court, and it’s unlikely that it would address any of the issues in this brief because these were not arguments made by the DOJ in its appeal.

The Lottery must file its response to the DOJ’s appeal by February 26.

FSGA Honors Best in Fantasy Sports, Sports Betting

The Fantasy Sports & Gaming Association (FSGA) handed out industry awards last week during its annual Winter Conference. Top honors, highlighting the best in fantasy sports and sports betting, were shared by The Fantasy Footballers and ESPN, which each took home five awards.

For the third year in a row, the Fantasy Footballers were named Small Business of the Year. ESPN swept the media hosting categories, with Field Yates named the Best Fantasy Sports Host and Doug Kezirian winning Best Sports Betting Host. Chris Fallica won Sports Betting Analyst of the Year honors, while the network’s Daily Wager program captured Sports Betting Video Show of the Year.

“In this first full year of expanding the scope of the association to include sports betting, I’m thrilled to see the quality of our nominees and winners,” said FSGA President Paul Charchian. “The innovation and talent we’re seeing is unparalleled and the future of our industry is bright.”

The 29 awards were voted on by FSGA membership, a media judging panel and fan vote.

Sports Betting Operators Storm Michigan

The Michigan sports betting scene includes new partnerships between sportsbooks PointsBet and FOX Bet and online casino operators, and federally-recognized tribes operating gambling facilities in the state.

In late December, Governor Gretchen Whitmer signed the Lawful Sports Betting Act and a pair of other gaming bills, which together will usher in legal, regulated sports betting into Michigan, as well as legal online gambling and poker.

Australia-based PointsBet, which opened the company’s first brick-and-mortar sportsbook in 2019 in Iowa, is currently active with operations or has access deals to launch in Colorado, Iowa, Illinois, Indiana and New Jersey. The Stars Group owns FOX Bet, as part of a partnership between the broadcasting and gaming companies.

PointsBet entered into an agreement to provide online and mobile sports wagering and gaming to be rolled out statewide, in conjunction with the Lac Vieux Desert Band of Lake Superior Chippewa Indians, which owns and operates the Northern Waters Casino Resort. According to a press release, PointsBet will pay the tribe market access fees as well as a portion of the net gaming revenues derived from the online sportsbook and online gaming operations.

The Stars Group struck a deal with the Little Traverse Bay Bands of Odawa Indians Gaming Authority which gives the sportsbook first-skin market access for sports betting, iGaming, and poker.

The flurry of activity comes after the legislature in 2018 passed bills legalizing sports wagering, only to see lame duck former Governor Rick Snyder veto the measure on his way out.

In Michigan and many states with significant tribal gaming presences, concerns over exclusivity and a reluctance to reopen their compacts has triumphed over the potential upside of adding legal sports betting. Proposals and conversations between operators have been ongoing throughout 2019 and continue now with greater urgency as 26 casinos in the state, 23 of them owned and operated by tribes, decide how to capitalize on their access to online brands.

The number of opportunities in the state is actually smaller than 26, as each tribe and each of three commercial operators will be able to offer one online sports betting product, as opposed to one brand per property. Under the law, each tribe can engage one partner apiece for each of online sports betting, online casino and online poker play.

One of the other Michigan tribes weighing its options is the Nottawaseppi Huron Band of Potawatomi, owner-operator of the FireKeepers Casino Hotel. In the Battle Creek Enquirer, Jim Wise, vice president of marketing at FireKeepers, said the tribe has begun negotiations with a sportsbook.

Penn National Gaming has a valuable skin in Michigan, too, as the new operators of the Greektown Casino-Hotel in Detroit.

It’s possible theScore Bet will get in through that deal via Greektown, but probably more likely that Penn National launches its own branded sportsbook and iGaming platforms powered by Kambi, which recently began divorce proceedings with DraftKings, which is merging with supplier SBTech to keep things in-house.

It’s a bit harder to predict the outcome for the MotorCity Casino Hotel, owned by Ilitch Holdings, a company established by the Ilitch family, which also owns the Detroit Red Wings and Detroit Tigers.

All operations online and systems at brick-and-mortar sportsbooks across the state will at some point have to pass muster during testing phases in accordance with forthcoming regulations by the Michigan Gaming Control Board, which the law tasks with regulatory oversight.

“After four years of hard work, I’m happy to see Michigan enter the modern era of gaming,” Michigan Rep. Brandt Iden said after his bill passed at the end of 2019. We’ll have a safe, regulated environment for thousands of Michigan residents who for years have been forced to travel to other states or play on risky offshore sites.”

Sportsbooks could be running, at least brick-and-mortars, in time for March Madness.

XFL, Genius Sports Launch Betting Integrity Program

The XFL, the startup professional football league that is the successor to the league formed by the World Wrestling Federation (now the WWE) and NBC has announced that it is partnering with Genius Sports on an integrity program to protect the league from illegal activity.

According to the partners, the “comprehensive integrity program” will help the XFL identify and deal with potential problems that arise from gambling on the league.

“Sports betting is growing rapidly in the U.S., and we are gearing up to be a good citizen and thoughtful participant in the marketplace,” Jeffrey Pollack, president and COO of the XFL, said in a press release. “Our alliance with Genius Sports is an important first step and foundational element.”

Genius Sports is a sports data company that collects and distributes statistics and content, including data related to betting. The company works with the NCAA, the NBA and the PGA Tour, among other leagues around the world.

“The XFL has shown an exemplary commitment to protecting the integrity of its games,” Genius Sports managing director Steven Burton said. “We are proud to partner with such a dynamic league and look forward to helping the XFL benefit from increased fan avidity by engaging with the nascent US sports betting industry.”

So what does the XFL get?

Under the agreement, Genius will provide monitoring of all pre-game and live betting markets, including alerts and analysis of odds movements.

At the XFL training camp this month in Houston, players, coaches and officials will go through integrity workshops conducted by Genius, to help educate stakeholders on “best practices to prevent betting-related misconduct.” It will also provide information on how much betting is expected on games and work on processes for reporting and investigating integrity-related issues.

Genius provides an online portal where staff and officials will be trained on league regulations and “the importance of integrity to the league’s future growth,” according to the XFL.

UK Bans Online Credit Card Bets

Starting April 14, online gamblers in the U.K. will no longer be able to use their credit cards to play. Last week, two years after groups including GambleAware and Citizens Advice urged the government to implement the policy, the UK Gambling Commission announced a ban on credit-funded bets.

Major operators including PokerStars, Betfair, 888 and Bet365 all allow their customers to make online deposits using credit cards. According to the Guardian newspaper, the commission estimates that 22 percent of people paying for online bets with credit cards are problem gamblers.

“Credit card gambling can lead to significant financial harm,” said Gambling Commission CEO Neil McArthur in announcing the imminent change. “The ban that we have announced today should minimize the risks of harm to consumers from gambling with money they do not have.”

So-called ewallets and services such as PayPal will “probably” be included in the ban, the publication reported, adding that in 2019, such providers allowed problem gamblers to circumvent banking limits and spend up to £150,000 a day.

“There is clear evidence of harm from consumers betting with money they do not have,” said Culture Minister Helen Whately, “so it is absolutely right that we act decisively to protect them. In the past year we have introduced a wave of tougher measures, including cutting the maximum stake on fixed-odds betting terminals (FOBTs), bringing in tighter age and identity checks for online gambling, and expanding national specialist support through the NHS Long Term Plan.

“We have also secured a series of commitments from five leading gambling operators that will include £100 million in funding towards treatment for problem gamblers. But there is more to do. We will be carrying out a review of the Gambling Act to ensure it is fit for the digital age and we will be launching a new nationwide addiction strategy in 2020.”

In addition to the credit card crackdown, the commission is also preparing to announce that membership of GamStop will become a condition of online casinos’ license to operate. GamStop allows people who want to block themselves from gambling voluntarily to give their details, which are then shared to prevent them from opening new accounts elsewhere.

Neil McArthur, Gambling Commission chief executive, said: “Credit card gambling can lead to significant financial harm. The ban that we have announced today should minimize the risks of harm to consumers from gambling with money they do not have. We also know that there are examples of consumers who have accumulated tens of thousands of pounds of debt through gambling because of credit card availability.

“There is also evidence that the fees charged by credit cards can exacerbate the situation because the consumer can try to chase losses to a greater extent.”

Culture Minister Helen Whately said: “Whilst millions gamble responsibly, I have also met people whose lives have been turned upside down by gambling addiction. There is clear evidence of harm from consumers betting with money they do not have, so it is absolutely right that we act decisively to protect them.

“In the past year, we have introduced a wave of tougher measures, including cutting the maximum stake on fixed odds betting terminals, bringing in tighter age and identity checks for online gambling and expanding national specialist support through the NHS Long Term Plan,” she continued. “We have also secured a series of commitments from five leading gambling operators that will include £100 million funding towards treatment for problem gamblers.”

“But there is more to do,” added Whately. “We will be carrying out a review of the Gambling Act to ensure it is fit for the digital age and we will be launching a new nationwide addiction strategy in 2020. We will not hesitate to take any further action necessary to protect people from gambling harm.”

One problem gambler, Chris Murphy, told the BBC he’s lost more than £100,000 (US$130,000) gambling online. Another, named Josh, said he lost £600 gambling online with a credit card, and then did “the worst thing possible. I chased the loss, which everyone says not to do, they say stop, don’t chase losses, you’re always going to be down in the long run.” Eventually, he lost more than £20,000.

“It progressed without me even realizing,” he said. “I’m looking at eight to 10 years to pay this off.”

Brigid Simmonds, chairwoman of the Betting and Gaming Council (BGC), said the industry group “strongly” support the requirement that all companies join GamStop.

“We will implement a ban on credit cards which adds to measures such as age verification, markers of harm and affordability checks, additional funding for research, education and treatment and new codes of conduct to protect the consumer,” Simmonds added.

Adam Bradford, co-founder of the Safer Online Gambling Group, called the credit card ban “welcome,” but “not a silver bullet to solve the problem.

“The gambling industry still needs to improve in many areas—for instance, performing better affordability checks on players and being more careful with its advertising.”

Marc Etches, CEO of GambleAware, added to the conversation, saying, “It is essential that every effort is made to protect those who may be at risk of experiencing gambling harm, so we welcome the decision by the Gambling Commission to extend the ban on using credit cards for online gambling, as well as offline.

“Gambling is a public health issue and mobile technology gives people access to gambling anytime, anywhere. Anyone who chooses to gamble should be able to do so in a safe environment, where the risks and available support options are made crystal clear.”

In an op-ed piece, Guardian columnist Rob Davies cited a “secret report” that said betting firms rely on VIPs to fill their coffers, and included the example of one operator that took 83 percent of all deposits from 2 percent of its customers. Another took 58 percent of its betting account deposits from 5 percent of its customer base made up of VIPs, while a third accepted 48 percent of deposits from 3 percent of customers. The data suggests that if the regulator bans VIP schemes, industry revenues could go into free-fall.

The report also called for a £2 stake limit on casino-style slots games, matching the restrictions imposed on FOBTs.

A UKGC spokesman said the body is preparing to address the issue.

“Operators must improve their interaction with VIPs and we have challenged the industry to make faster progress to improve how they manage their customers,” the spokesman said. “We have also taken robust action against operators who fail to protect consumers and we will be even tougher if behavior does not change.”

EGBA to Spain: Don’t Overregulate iGaming

The European Gaming and Betting Association (EGBA) has reminded the Spanish government that new gambling regulations must be :balanced and proportionate” to be effective.

While reiterating its support for the measures, published in December, it said the new measures must be “designed in such a way that they support rather than undermine the regulated market.”

In a statement on its website, EGBA Secretary General Maarten Haijer said, “In the past, we have seen, in various jurisdictions, the introduction of well-meaning consumer protection measures which had an actual counterproductive effect because they pushed online players towards unregulated, off-shore websites which exposes them to dangerous practices and a lack of legal recourse when their consumer rights and protections are being trampled on.

The Spanish government “should pay attention to this risk,” Haijer continued,” and ensure that new measures are mindful of the need to ensure a high participation rate of players in the Spanish regulated market, rather than the offshore market.

“This is true particularly in respect to advertising, which is a vital instrument to direct players to the gaming and betting websites which are licensed and regulated Spain—and away from risky websites.”
