MGM Resorts and Golden Nugget Apply for Pennsylvania Online Gambling Licenses

The latest round of Pennsylvania online gaming license applications saw two powerhouses in New Jersey’s online market looking to cross the border and expand their online offerings.

Golden Nugget is seeking to gain a slots license and a table games license at a cost of $4 million each. MGM is seeking licenses for both as well as a license for online poker.

Golden Nugget operates the leading online casino sites in new Jersey including a partnership with Pennsylvania’s Sugar House casino. It is also partnered in the state with Betfair. The three sites have taken in nearly $76 million in revenue this year.

There had been speculation that Golden Nugget would opt to enter the market through its partnership with Sugar House, but it has instead moved for its own licensing.

MGM operates the Borgata casino in Atlantic City and has recently struck several major deals to expand its sports betting options in the U.S., including with the NBA and NHL. It has also partnered with Boyd Gaming, which owns the Valley Forge casino in Pennsylvania.

The Pennsylvania Gaming Control Board will now take review the applications.

Wynn Sues Wynn

The relationship between Steve Wynn and his former company just went from bad to worse.

Wynn, who was forced out as chairman and CEO, and a chief shareholder of the company he founded following allegations of sexual harassment and assault, filed a suit in Clark County, Nevada, against Wynn Resorts and the Massachusetts Gaming Commission. Wynn alleges that the company released information to the commission that was protected under attorney-client privilege and therefore should not have been passed on.

In the suit, Wynn asks that a report complied by the commission on his alleged activities be blocked because it “contains, discloses or otherwise relies upon Mr. Wynn’s attorney-client privileged communications or other protected material, including material protected by Mr. Wynn’s privacy rights.”

There was no response from Wynn Resorts, but the Massachusetts Gaming Commission said it wasn’t surprising given Wynn’s “litigious tendencies.”

“The commission has retained legal representation in Nevada to mount a vigorous defense against his effort to block the release of our months-long investigatory report and to defend against Mr. Wynn’s baseless claims for damages,” said commission spokeswoman Elaine Driscoll. “It is our intention to bring this matter to a swift resolution. The commission’s investigative arm remains focused on its preparations to soon present the commission with the full extent of its findings.”

At the very least, however, observers expect the release of the report to be delayed. It was scheduled to be discussed in December.

Meanwhile, the third-quarter earnings report for Wynn Resorts was a mixed bag for the company. CEO Matt Maddox revealed that the company had halted work on Paradise Park, Steve Wynn’s vision with a lake, another hotel and other non-gaming attractions. Maddox said work on the expansion of the convention space at Wynn Las Vegas would continue. He also said the golf course would be reopened, and the company has brought in the original designer of the course, Tom Fazio, to rebuild the affected areas. According to Maddox, closing the course cost the company between $13 million and $15 million in ancillary business.

In Macau, Maddox said Wynn Palace will add two hotel towers with approximately 1,300 rooms to its seven-acre property in the city’s Cotai district. Construction of the hotels and a non-gaming destination called the Crystal Pavilion will begin construction in 2020.

Maddox said the plan will “take that property from 1,700 hotel rooms to over 3,000, which is really where we need it to be.

“We have a seven-acre (2.83-hectare) parcel next to Wynn Palace and we’ve been working very hard on what could come next,” Maddox said. “What we have so far is a 1.5 million-square-foot (139,355-square-meter) facility that we think will be a must-see in Macau.” Maddox added that the Cotai property “needs more hotel rooms” to reach EBITDA of more than US$1 billion. Also in the plan is a glass structure, the Crystal Pavilion, featuring a “fully immersive” theater, he said.

“We plan on presenting this concept in the next couple of months working through 2019 on the permitting, finalizing the design, getting everything together and beginning construction in 2020.” He said it’s too early to talk about cost or possible opening dates.

According to GGRAsia, Wynn Macau Ltd. reported total operating revenues of approximately US$1.31 billion in the third quarter, up 20.5 percent year-on-year. Casino revenue was up 19.4 percent to about US$1.131 billion on the strength of Wynn Palace. Net profits were nearly US$223.5 million in the three months to September 30, more than double compared to US$90 million during the same period in 2017.

The Wynn Palace generated operating revenues of US$730.6 million for the third quarter, an increase of 39.1 percent from a year earlier. Third-quarter gaming revenues were US$625.6 million, up 39.9 percent from the prior year. Table games turnover in VIP operations was US$15.53 billion, a 13.4 percent year-on-year increase. VIP table games win was up 3.01 percent, and table drop in mass-market operations up 37.3 percent to US$1.19 billion. Operating revenues from Wynn Macau came to US$579.6 million for the third quarter, up 3.1 percent from the prior-year period.

Casino revenues from Wynn Macau were US$503.6 million for the period, a less than 1 percent increase from 2017. Table games turnover in VIP operations was US$13.97 billion, up 4.4 percent, and table drop in mass-market operations was US$1.18 billion, an increase of 10.6 percent over 2017.

And finally, Phil Satre is the new chairman of Wynn Resorts.

Satre, a legend in the gaming industry from his years at the helm of Harrah’s Entertainment, and the choice of activist shareholder Elaine Wynn for the post, officially succeeded to it in an announcement from the board issued last Wednesday.

His appointment caps a tumultuous process led by Wynn and dating back to the spring to reshape the company’s board of directors following the sexual harassment allegations that forced out her ex-husband, Steve Wynn, and made her Wynn Resorts’ largest individual shareholder.

Satre, who joined the board in August as vice chairman, replaces long-time chairman D. Boone Wayson, a close family friend of Steve Wynn’s who’d been with the company since its inception.

Wayson is retiring from the board.

Satre resigned as chairman of slots and systems giant International Game Technology when he joined the Wynn board but remains president of the National Center for Responsible Gaming. He also has served as chairman of Nordstrom Inc. and Nevada utility provider NV Energy and as a director of Rite Aid Corp. He is a member of the American Gaming Association’s Gaming Hall of Fame.

Harrah’s was arguably the most admired company in the industry during his long tenure as chairman and CEO, making him a good fit to head a board that has been almost completely reconstituted since the Wynn scandal with six new directors and now includes four women.

His presence is expected to exert a steadying effect on a company still reeling from the scandal and provide support for new CEO Matt Maddox’s efforts to foster a more progressive corporate culture. It should go a long way as well toward appeasing regulators concerned that Wynn executives and members of the old board neglected to act on complaints from female employees about the casino tycoon’s alleged abuses and worked to cover them up.

The appointment also concludes months of hostilities between the company and its largest shareholder.

Elaine Wynn had aggressively challenged the board’s composition beginning in the spring, after Steve Wynn sold all his shares in the company and gave up a court battle dating back years over control of her stock.

In exchange for Satre’s appointment she has agreed to cap her current ownership stake, not nominate anyone to the board or seek to add additional members, not enter a proxy fight, and not seek to influence board members or senior management. She also has agreed to vote her shares in accordance with the board’s recommendations.

Rapper Claims Profiling by Parq Casino

Rapper Musician Drake claims that he was racially profiled by Vancouver’s Parq Casino, which would not allow him to play at the casino.

Drake posted this criticism on Instagram last week, calling the B.C. casino the “worst run business I have ever witnessed … profiling me and not allowing me to gamble when I had everything they originally asked me for.”

Parq is the only casino resort in Vancouver’s downtown. Its president, Joe Brunini, issued this statement about the incident. “We are operating in one of the most complex, highly regulated industries and are always looking to better our communication and customer service.”

Those regulations now require that casinos provide a “source of funds declaration” for any amount received of more than $10,000. The implication from Brunini’s statement may be that Drake declined to provide such information. He added, “We are constantly improving our communications process to ensure that these new regulations are better understood by all guests.”

The casino is experiencing a storm of criticism on social media because of Drake’s comments. He has more than 50 million followers on Instagram.

Hard Rock Atlantic City Fined by New Jersey Regulators

New Jersey gaming regulators have fined Hard Rock Hotel & Casino Atlantic City $5,000 for failing to follow state rules in its appointment of a new marketing director.

The state Division of Gaming Enforcement issued the fine after Hard Rock did not properly petition for qualification or notify regulators of the appointment of Mann Lien as the property’s vice president of Asian marketing, as required by the Casino Control Act.

The division noted that Lien, who already possesses a casino key employee license, began his employment on July 9. The division was not notified of Lien’s employment until Oct. 22, according to the letter, and only found out after inquiring with the casino hotel.

In another Atlantic City matter, Moody’s Investment Services has upped Atlantic City’s “Long-Term Issuer Rating” from Caa3 to B2 status since March, meaning that it has increased from a very high credit risk to “being speculative and a high credit risk.”

“The outlook remains positive,” the report stated. “The B2 Long-Term Issuer Rating reflects the city’s continued, albeit reduced, financial and economic distress.”

The city faced bankruptcy in 2017, but has been under state fiscal control since a series of measures were passed by the state to help the city out of its financial difficulties. That has included settling several large tax judgements against the city brought by casinos.

Pennsylvania Sports Betting to Launch

Five of 13 available licenses granted

By all estimations, Pennsylvania’s newly legal commercial sports betting operations are about to begin. With the Pennsylvania Gaming Control Board’s approval October 31 of sports betting licenses for to Harrah’s Philadelphia in Chester, SugarHouse Casino in Philadelphia and Rivers Casino in Pittsburgh, the only remaining question was which casino would be the first to go live with a sports book.

Last week, it became clear that Hollywood Casino at Penn National Race Course in Grantville will get the honor of launching the state’s sports-betting industry, after the gaming board approved William Hill US as its partner, which will operate the Hollywood sports book.

Penn National could be up and running within weeks or even days, according to comments by a spokesman for the operator to CNHI News Service. “We’re hoping to begin around the middle to the end of this month but are still awaiting final sign-off,” said Eric Schippers, a spokesman for Penn National said on November 2. That final sign-off appears imminent.

William Hill US, the subsidiary of the British bookmaking giant, already operates sports books in a number of other states, including on behalf of Penn National in Mississippi and West Virginia, as well as New Jersey, Delaware and Nevada.

“Hollywood should move forward now pretty briskly,” Doug Harbach, a spokesman for the Gaming Control Board, told the news service. “Most of the work going forward is in the hands of the casinos, which must get their physical location set up.”

Penn will be the first of several physical and online sports books that will open over the next few months. Parx Casino in Bensalem, which had been expected to start operations around the same time as Hollywood, told the Play Pennsylvania news site last week that it will launch a temporary sportsbook sometime “in the next few months.”

The temporary Parx Sportsbook will open in the former 360 bar while construction proceeds on the permanent facility. Parx parent Greenwood Gaming announced it is investing $10 million into the permanent sports book, which will feature a full roster of betting options, including a selection of in-game betting.

“Parx Casino is thrilled to announce the launch of legalized sports betting on property and construction of a sleek, state-of-the-art Parx Sportsbook,” said Senior Vice President of Interactive Gaming Matthew Cullen in a press release. “We will build the best sports book in the country—and set the industry standard for this fast-growing arena.”

The temporary sports book will feature 28 high-definition television screens and two 16-by-9-foot display screens, with the ability to broadcast 36 different events at once. There will be seven teller windows and 45 self-service betting kiosks in the book on the casino floor and in the poker room.

Meanwhile, Rivers Casino in Pittsburgh, owned by Rush Street Gaming, is planning for its sports book to be open by early December. In a brief hearing prior to the board’s October 31 vote, representatives of Rush Street Gaming, set December 1 as their target date to open the sports book at Rivers. There will be a temporary location next to the casino’s high-limit room with a permanent location expected to be completed early next year.

“Essentially, sports is in our DNA at the property here in Pittsburgh,” said Andre Barnabei, Rivers vice president of slot operations, in an interview with the Pittsburgh Post-Gazette. Like Hollywood Casino and others, the book will take wagers on professional and collegiate sports, and will include in-game wagers. The temporary sports betting space at the Rivers will encompass more than 3,000 square feet that will include 98 seats, 15 wall televisions to view games, a bar with video poker games, self-service betting kiosks and a counter with staff taking wagers.

Rush Street Interactive partners with the Kambi Group, which is based in Europe and operates sports books around the world. The SugarHouse Casino in Philadelphia, which is also owned Rush Street Gaming, received its own approval October 31 to use the same providers with intent of also taking sports bets starting December 1.

Harrah’s Philadelphia in Chester will not be far behind. “We thank the Pennsylvania Gaming Control Board and look forward to working with them to bring a best-in-class sports betting offering to market,” said Harrah’s Philadelphia Senior Vice President and General Manager Chris Albrecht in a statement. “We know Pennsylvanians are passionate sports fans and we are working hard to be ready to launch a sports book at Harrah’s Philadelphia along with a mobile product when first given the go-ahead.”

Harrah’s will build out a 4,322-square-foot sports book facility inside its existing facility with an expanded food and beverage offering. The proposed sports book area would be adjacent to table games and feature 40 flat-screen televisions with packages for all major sports leagues, as well as international and college sports packages.

The area will also include an odds board, six teller windows, self-betting kiosks, two horseracing terminals and stadium-style seating, according to the presentation the company gave before the gaming board.

“This was just another sort of step in the process here, but we don’t have a ‘go-live’ date,” said Seth Palansky, vice president of corporate communications for Caesars Interactive Entertainment, in an interview with the Delco Times. “You have to get your software in and approved for online, that sort of thing. We don’t know if we will get it in this (football) season or not.

“From our standpoint, there might be some additional applications for any partners they have for licensing, and then eventually we’d have to make sure the equipment is tested and works correctly, and then have some test sessions on-site just before the opening so we can sign off on it opening to the public,” Harbach told the newspaper.

Harrah’s will offer on-site sports betting as well as mobile and interactive sports wagering at its Chester location, using the Scientific Games Open Bet platform.

NCAA Forms Sports Betting Committee

The National Collegiate Athletic Association announced the formation of a special committee to examine sports betting and its potential impact on collegiate athletics. The Board of Governors Ad Hoc Committee on Sports Wagering will assess the potential risks of sports betting as more states legalize the activity.

“Reflecting the NCAA’s continued commitment to student-athlete well-being and protecting the integrity of competition, the association’s top governing board voted this week to establish a membership committee to address the expansion of legalized sports wagering,” wrote the NCAA in a press release.

“The Board of Governors Ad Hoc Committee on Sports Wagering will examine the sports wagering landscape and its potential impact on current NCAA rules, educational efforts, player availability reporting, and any associated risks as more states legalize sports wagering.

“The NCAA and its members continue to take a thoughtful approach to the issue of sports wagering,” G.P. “Bud” Peterson, chair of the Board of Governors and president of Georgia Tech, said following the board’s meeting Oct. 23. “The core values of protecting student-athlete well-being and the integrity of competition are at the heart of these efforts. We must continue to evolve and adapt our approach as the landscape continues to change and sports wagering expands in the United States.”

Current NCAA rules that prohibit sports wagering by student-athletes or athletics employees, including coaches and other individuals connected with athletics, remain in effect. Violations of any sports wagering rules remain subject to NCAA penalties.

The committee will work with the national NCAA office, student-athletes and other organizations to build upon the NCAA’s existing efforts related to sports wagering rules, policy, research and education, the release said.

“Protecting our student-athletes through education related to gambling prevention is an important aspect of our efforts,” said Glen Jones, vice chairman of the board and Henderson State president. “As the prevalence of legalized sports wagering continues to expand, we are focused on our responsibility as educators and administrators to equip student-athletes with the information and tools they need to understand the expanding sports wagering environment.”

The NCAA Sport Science Institute is also planning a Sports Wagering and Well-Being Summit in March, which will bring together sports wagering organizations and professionals specializing in mental health and wagering disorders. These experts will identify tools and initiatives the NCAA may develop to address issues of sports wagering and problem gambling in the college student population.

Massachusetts Wynn Investigation May Extend to December

The results of an investigation by the Massachusetts Gaming Commission of Wynn Resorts begun shortly after Steve Wynn resigned from the company that bears his name due to sexual misconduct allegations and ended all ties to it, could publish its findings near the end of the year. The document is expected to be several hundred pages long.

The commission will use the investigation into the continued suitability of Wynn to operate the $2.4 billion casino it is building in Everett to decide to decide whether it will keep its license. Wynn has consistently insisted that he has never done anything improper.

Executive Director Edward Bedrosian told the commission last week, “Once the report is complete, there are a few more procedural steps before an actual hearing and the report will be made public.” He added, “First, the commissioners individually will be provided a copy of the report along with the exhibits. We anticipate that will consist of hundreds of pages of documents.”

The report, including all of the supporting materials, will also be delivered to Wynn Resorts.

The investigators and Wynn will each make presentations to the commission, which will decide the company’s fate in the Bay State.

Bedrosian continued, “It would be at the beginning of the actual hearing the report, with any redactions, will be made public. With all that in mind, I anticipate and hope that we can have any pre-hearing motions, again if any, heard some time in November with the actual hearing happening sometime the first two weeks of December.”

The investigators have been looking at not only Wynn’s conduct, but how the company’s executives dealt with it. Including the very important aspect of whether they deliberately hid the former casino mogul’s conduct form the commission at the time when it originally decided the company’s suitability for a license in 2014.

A bombshell article by the Wall Street Journal in January brought down Wynn’s dominance of the company when it wrote of “decades-long pattern of sexual misconduct” and a pay-off of $7.5 million by Wynn to a manicurist who accused him of attempted rape. This incident and payment were not disclosed as part of the licensing process.

The investigation is headed by Karen Wells, who commented earlier this year, “A central question is, what did the board of directors and staff know and when did they know it, about the settlement and the associated allegations.” That question has been echoed by other commissioners, including former Chairman Stephen Crosby, who before he resigned several weeks ago emphasized that it was important for both the commission and the public to know the answer. Crosby resigned because of criticism that he could not impartially decide this issue.

In August Bedrosian reported that investigators were entering the final phase of the probe. The panel anticipated beginning public hearings in September, then learned that the investigators needed more time to tie up all the ends.

Once the commission has heard presentations, including under oath statements, and any questions it chooses to ask participants, it will go into closed session to make its decision. Attorneys for Wynn will also be permitted to ask questions of witnesses.

The panel could, if it chooses, take away the license from Wynn, forcing it to sell the Encore Boston Harbor to some other entity.

MGM Springfield

The MGM Springfield Career Center is relocating its operations to the MGM Springfield administrative building on 95 State Street. At the moment it offers information on more than two dozen current job openings.

It has operated at the Colvest Building on East Columbia Avenue for more than a year. In that location it helped fill 3,000 positions for the $960 million casino. Now its task is considerably less challenging, and so it can be handled in the administrative building.

Vice President of Human Resources Marikate Murren commented, “We are excited to be moving closer to the daily activity on property.” She added, “There continues to be many promising career opportunities at MGM Springfield, and we look forward to working with enthusiastic job seekers at our new location.”

The career center will offer hiring services, interviews, licensing and training. It even provides computers to possible employees to build their career profile and interview rooms. It also provides an office to the Massachusetts Gaming Commission to assist in licensing employees.

The Center is open two days a week.

PA Board Approves Three More Sports Betting Applications

The Pennsylvania Gaming Control Board approved three new sports betting petitions last week, brining the total number of licensees with approved sports betting to five.

At its meeting last week, the board approved petitions to offer both live and online sports betting to Harrah’s Philadelphia in Chester, SugarHouse Casino in Philadelphia and Rivers Casino in Pittsburgh, which join Penn National Gaming and Greenwood Gaming in planning to open both on-property and online sports books.

SugarHouse and Rivers, both owned by Rush Street Gaming, are targeting a December 1 launch for their sports books, which operate on the popular OpenBet platform from Scientific Games.

Harrah’s, whose property also uses the Scientific Games sports book platform, had been expected to offer sports books, given that parent Caesars Entertainment already offers both online and live sports books in New Jersey, along with sports wagering at properties in Mississippi and Nevada.

Harrah’s officials gave a presentation before the that will be complete with 40 flat-screen TVs, an odds board, six teller windows, betting kiosks and two horse-racing terminals. Stadium-style seating will give bettors a view of a variety of games.

Rivers in Pittsburgh is building a temporary sports book including cashier windows and self-serve kiosks, slated to open December 1. The permanent book will replace the current Levels Lounge on the casino floor. IT will debut early next year, according to Rush Street officials.

The SugarHouse also will launch a temporary sports book December 1, with the permanent location, slated to open next spring, replacing the Lucky Red Lounge on the casino floor.

While only five of the 13 Pennsylvania licensees have secured licenses for sports betting, several others are expected in the coming months, including Sands Bethlehem, when its new owner, the Poarch Band of Creek Indians, takes control of the property from Las Vegas Sands. Tribal officials have already indicated that the converted Wind Creek Bethlehem will include a sports book.

Additionally, Mount Airy Casino in the Pocono Mountain region has announced it will offer sports betting in partnership with PokerStars parent Stars Group. Erie’s Presque Isle Downs, recently purchased by Churchill Downs, also is expected to apply for sports betting.

Virginia Lawmaker Plans Sports Betting Bill

In Virginia, state Del. Marcus Simon announced he’ll introduce a sports betting bill when the legislature reconvenes in January 2019. “I think there is certainly a revenue opportunity in Virginia. We already see a lot of our residents’ dollars go across the river to MGM National Harbor. We lose out on a lot of opportunities to capture some of that revenue,” Simon said. He added his legislation would allow legalized sports betting starting in July 2019.

MGM National Harbor is located near Washington, D.C. where lawmakers are also considering a sports betting bill. However, Virginia Governor Ralph Northam has not taken a stand on sports wagering. His spokesperson Ofirah Yheskel said, “Governor Northam believes any future proposal to expand sports gaming here in Virginia should be considered with the input of the general assembly and the communities that will be impacted.”

Casinos are banned in Virginia but Simon said sportsbooks could be located at racetracks and off-track betting parlors. Currently no racetracks operate in the state but Colonial Downs plans to reopen in March 2019; among its offerings will be historical horseracing machines. Simon noted, “I think you can probably find a way to combine sportsbooks with the existing horse racing and off-track betting that exist. And there is probably a way to facilitate online sports gaming as well.”

Penn Details York Mini-Casino, Proposes Second in Berks County

Hollywood Casino Morgantown would be in Caernarvon Township, Berks County

The township of Springettsbury, Pennsylvania, hosted a hearing of the Pennsylvania Gaming Control Board at its township building last week, to hear testimony on Penn National Gaming’s planned mini-casino in the township.

Before that hearing was done, the operator announced that it has filed its application with the board for its second Category 4 satellite casino, to be built on a 36-acre site in Caernarvon Township, in Berks County near the city of Morgantown.

At press time, there were few community representatives on the list to speak before the board in York hearing, but Penn National officials offered a more complete view of the mini-casino it will call Hollywood Casino York, to be located in a former Sears location at the York Galleria mall.

The Gaming Control Board hosted the public hearing as part of its process to determine whether to grant a license for the casino, said Doug Harbach, a spokesman for board, in comments to the York Daily Record.

At press time, the newspaper listed mostly Penn National Gaming management and community leaders, including Kevin Schreiber and Blanda Nace of the York County Economic Alliance, and Springettsbury Township supervisor Charles Wurster. Only two individuals had signed up to speak.

Penn National plans to open with 500 slots and 20 gaming tables, according to the application. A mini-casino, or Category 4 license, authorizes an existing state licensee a satellite facility with 300 to 750 slot machines and, with an additional $2 million added to the $10 million license fee, up to 30 table games initially, with option to add 10 more live tables later.

Hollywood Casino York also will have a 136-seat casual dining restaurant, a 32-seat bar, a lounge with a small stage and a 23-seat Grab N’ Go Grill in the casino, the application states.

Meanwhile, the company announced that Hollywood Casino Morgantown, near the intersection of state Route 10 and the Pennsylvania Turnpike, will be a ground-up, 80,000-square-foot facility offering both slots and table games. According to Penn officials, the $111 million facility will open with 750 slots and 30 table games, and will include a sports and race book, a signature restaurant, an entertainment lounge and a food court.

The company said the facility is expected to generate approximately 250 new local jobs and more than 275 construction jobs. Following receipt of the license, it is estimated that the construction would take 18 months.

“While we explored numerous locations for our Category 4 casino in and around Berks County, the site we selected is unparalleled in terms of ease of access to three major arteries,” said Penn National Gaming CEO Timothy J. Wilmott in a statement. “Hollywood Casino Morgantown is ideally situated to generate new revenues from the more densely populated suburbs to the west of Philadelphia, while further protecting our existing market share at Hollywood Casino at Penn National Race Course.”

Classmates Hope to Use Gaming To Revive Virginia Town

If and when casinos are allowed in Virginia, two former high school classmates hope such a facility opens in the former Bristol Mall. The United Company Chief Executive Officer Jim McGlothlin and Par Ventures LLC President Clyde Stacy already put “We’re Betting On Bristol!” on the empty mall’s outdoor sign. They said their privately financed $150 million venture could provide an economic boost for the region on the Tennessee state line where the coal industry has declined and recently Bristol Compressors announced it was closing its local plant, eliminating 468 jobs.

The Bristol project would include a 100,000 square foot casino, hotel, restaurants, shops, conference center, go-kart track, water park and entertainment venue. An economic study commissioned by McGlothlin indicated the project would create 2,000 jobs and generate $567 million in local and regional economic impact.

For a Bristol casino to become reality, the Virginia General Assembly would have to legalize casino gambling. McGlothlin said he hopes that happens in the 2019 session. In the most recent session, lawmakers legalized historical horseracing. “That was done to help the equestrian groups. Surely you would want to help a struggling city,” McGlothlin said.

Republican state Senator Bill Carrico, whose represents Bristol, opposed the historical racing machines measure. “I’m not committed one way or another to the casino. Even if legislation goes through, Bristol people should have the final say through a public referendum.”

Bristol Vice Mayor Kevin Wingard said, “If we can’t attract high-tech jobs, then we have to look at what is being proposed. I believe this project will put Bristol and Southwest Virginia on the map and turn things around.”

William Hill Offers $308 Million for Mr Green

William Hill Plc is seeking to acquire Swedish-listed Mr Green & Co AB for about $308 million in what as seen as a move by the UK bookmaker to lessen its reliance on British-based online operations in the face of tightened gambling regulations in the UK.

According to Reuters, the acquisition would combine William Hill with MRG’s Mr Green and Redbet brands.

William Hill shares rose more than 8 percent after news of the deal was reported and MRG shares rose 47 percent to 68.40 Swedish crowns, close to the acquisition offer price of 69 crowns, Reuters reported. MRG operates in 13 markets and has an international hub in European Union member Malta.

“We get a ready to go international hub,” Philip Bowcock, William Hill’s chief executive officer told Reuters. “As a part of Brexit, we have to create an international hub outside of Gibraltar operations.”

If William Hill kept its Gibraltar operations, it would be subject to the new tax increase announced last week.

Mr Green holds remote gambling licenses in Denmark, Italy, Latvia, Malta, Britain and Ireland and expects to obtain Swedish licenses by the end of the year.

William Hill offered a near 49 percent premium to MRG’s closing price of 46.5 Swedish crowns on Tuesday. The deal has been recommended for approval by Mr Green & Co’s board and shareholders who own over 40 percent of MRG accepted the offer, Reuters said.

The move comes as the UK government announced it will increase its online gambling tax from 15 percent to 21 percent.

Pennsylvania Fantasy Sports Betting Nears $1 million

As the first half of the NFL football season comes to an end, fantasy sports betting on Pennsylvania’s nine licensed fantasy sports sites is still growing. According to a report in Lehigh Valley Business, fantasy sports betting has generated nearly $1 million in tax revenue since its launch in May.

The revenue numbers accelerated with the start of the NFL season in September, a month when sites that include national names like DraftKings, FanDuel and Yahoo Fantasy Sports generated $320,000 in tax revenue on revenue totaling $2.13 million. By comparison, in July, the sites generated $133,000 in taxes on revenue of $878,000.

The state takes 15 percent of all fantasy sports wagers under the gaming law. Since May, the state has taken in around $947,000 in new taxes on fantasy sports.

DraftKings, FanDuel Win Indiana Lawsuit

The Indiana Supreme Court recently ruled that DraftKings and FanDuel did not violate players’ “right of publicity” because their use of player data, statistics and names “falls within the meaning of ‘material that has newsworthy value,’ an exception under the statute.” The court said it made no difference that DraftKings and FanDuel used the stats and information in contests that required entry fees and awarded cash prizes.

In its decision, Justice Steven David wrote, “Defendants’ use of players’ names, images, and statistics in conducting fantasy sports competitions bears resemblance to the publication of the same information in newspapers and websites across the nation.”

The suit was brought by three former Northern Illinois University football players, Akeem Daniels, Cameron Stingily and Nick Stoner who claimed they should be compensated by DraftKings and FanDuel for the use of their names and statistics. The case was filed in 2016 when the two companies only operated daily fantasy sports websites; now both also offer sports betting. The claimants cited Indiana’s right of publicity law which states a company cannot use a person’s name or likeness without permission.

A previous federal court case also was dismissed based on the “newsworthiness” exception. R. Stanton Dodge, DraftKings’ chief legal officer, said, “Sports statistics–and the ability for all fans to freely access them–have always been at the center of the American sports fan experience.”

American Gaming Association Vice President of Government Relations Chris Cylke said the Indiana ruling “builds on the already extensive jurisprudence concluding facts are not protected under IP and/or right of publicity laws. As it relates to sports betting, we hope this further encourages sports leagues and player associations to work constructively with the gaming industry to establish a robust legal market for betting, which our research shows will be worth more than $4 billion in new revenue to them. Attempting to use legislatures and the courts to extract fees and direct payments from sports book operators severely undercuts the prospects of success for a legal market that can benefit consumers, operators, leagues and governments alike.”

Cylke continued, “The emergence of new advertising partnerships between operators and sports teams further underscores the fact that the gaming industry has been embraced by Americans as a mainstream form of entertainment. AGA is committed to working with our members and other stakeholders to ensure sports betting advertising is done responsibly, whether on television, the internet or in stadiums and arenas around the country.”

Gibraltar Reaches Agreement with Spain On Gambling Industry

Gibraltar has reached a tentative agreement with Spain to protect its gambling industry and its workforce in the face of concerns over how Brexit will affect the Overseas British Territory.

About 14,000 people commute daily between Gibraltar and Spain, most of which work in the gambling industry. The UK’s scheduled leaving of the European Union in March has raised questions about how those workers will be affected. The UK yet to reach a final deal on its departure from the EU.

Gibraltar and Spain have now agreed to their own deal ahead of a UK deal which would allow the arrangements between the two countries to stay stable assuming the UK makes a deal with the EU.

Gibraltar Chief Minister Fabian Picardo said “common sense has prevailed” and the territory has agreed terms with Spain on issues such as customs, policing and the environment, according to the Times of Malta.

Gibraltar has been working to preserve its gambling industry ahead of Brexit. In July, the territory set out changes to licensing and duties as part of preparations for impact of the change. Still major companies like Bet365 and 888 Holdings have announced they will be relocating some operations to Malta.
