Delaware Will Consider Casino Tax Breaks

Delaware Governor John Carney has told lawmakers he will not further delay debate on a package of tax and fee breaks for casinos, according to a report in usaonlinecasino.com.

Carney had asked the state Senate Finance Committee in March to temporarily shelve Senate Bill 144 until after the state received revenue reports on franchise and personal income taxes. Last week, he gave lawmakers the green light to proceed.

The bill would change the state slot revenue tax from 43 percent to a sliding scale ranging from 32 percent to 43.5 percent, slash the revenue tax on table games from 30 percent to 15 percent, and eliminate the annual $3 million table-game licensing fee.

The three racinos have been begging the state for tax relief for years, as they have been struggling against new competition in Maryland and Pennsylvania. So far, the legislature has shot the request down every year since the formation of a blue-ribbon panel of state and industry officials first proposed the tax breaks four years ago.

State Senator Brian Bushweller, the bill’s primary sponsor, has argued that failing to grant the casinos tax relief puts 3,000 jobs at risk, as Dover Downs and others have threatened layoffs if the tax structure is not altered.

Building a Better Wynn for Employees

Wynn Resorts has established a new Culture and Community Department dedicated to supporting diversity, gender equality and fair treatment in the workplace.

The department is the second major employee-focused initiative since Matt Maddox took over as CEO two months ago amid a sexual harassment scandal that forced the resignation of Steve Wynn.

Wynn, who has denied any misconduct, resigned as chairman and chief executive in February and has since sold off his sizable financial interest in the company. But his shadow still hangs over the company, cast by allegations that he regularly pressured female employees to perform sex acts, that he’d been doing it for years, and that their complaints to higher-ups were ignored as an unspoken matter of policy. Now, regulators in Nevada and Massachusetts want to know what the board of directors and top executives may have known about all this. The company also is facing a slew of lawsuits from angry shareholder groups who believe their trust as investors has been violated.

Maddox, a charter member of the management team and one of the executives said to be closest to the disgraced tycoon, has moved energetically to repair a corporate image that’s been badly tarnished. Within days of becoming chief executive he announced a new family leave policy, a new employee scholarship program and a mechanism for providing paid time off for workers involved in outside charitable activities.

The new Culture and Community Department he unveiled this month has a broad remit to promote employee diversity, inclusion, education and professional development and foster stronger relations with the larger community.

“Now more than ever we are committed to ensuring equality, creating leaders, and giving back to the communities in which we operate,” Maddox said. “The launch of our Culture and Community Department speaks to this promise and will help us continue to be the industry employer of choice.”

Heading the department is Corrine Clement, who has held top positions in marketing, community relations and human resources for companies as diverse as MGM Resorts International, Coca-Cola and the Phoenix Suns. She has worked for Wynn Resorts since 2014, serving as executive director of human resources for Wynn Palace in Macau and most recently as executive director of innovation and creative development at Wynn Las Vegas.

The company describes her as an “avid fund-raiser” who has “helped raise millions of dollars from employee-giving campaigns for a wide variety of causes”.

One of the department’s signature campaigns is a Women’s Leadership Forum. Its goals are many: tackling gender gaps in management; providing career growth opportunities for female employees at all levels; promoting pay and title equity; and, not least, ensuring a safe workplace. The forum will be conducting focus groups, studies and surveys designed to pinpoint inequities and help shape new programs to address them and will be sponsoring mentorships and panel discussions and town hall meetings related to these aims.

The company said more initiatives like these are in the works and they will be shared publicly.

NetEnt Partners with Hard Rock New Jersey

NetEnt Americas has signed a customer agreement with Hard Rock Hotel & Casino Atlantic City for the distribution of online games.

Hard Rock International operates one of the largest global hospitality businesses with casinos, hotels and restaurants, and will soon offer online casino gaming from its new land-based casino in New Jersey.

N.Y. Lawmaker Calls for Online Betting Task Force

A New York state lawmaker has introduced a bill creating a task force to study the regulation of online sports betting.

The measure (A10322), advanced by Assemblyman Clyde Vanel, comes a month after a bill (S7900) was introduced in the Senate to legalize the industry at OTBs, casinos and racetracks and racinos and via mobile platforms. Sponsored by Republican John Bonacic, who chairs the Judiciary and Racing, Gaming and Wagering committees in the upper house, S7900 is the latest in a string of failed attempts to bring sports betting to New York.

Vanel, a Democrat representing Queens, wants to install a 10-member legislative task force to examine policies and best practices regarding online betting. Should his bill pass, it would require the task force to report its findings and make recommendations no later than Dec. 31, 2019.

Though proponents have yet to see a companion bill to Bonacic’s in the Assembly, momentum has been building in Albany to legalize sports betting after the U.S. Supreme Court agreed to hear New Jersey’s appeal against a 25-year-old federal ban on the industry. The court is expected to render a decision later this year.

It’s possible also that a perceived need to develop new revenue sources is gaining steam in the Legislature after a disappointing first year for the state’s new commercial casinos, which are seeking tax breaks after falling well short of initial revenue projections in one of the most supply-heavy gaming markets in the country.

Bonacic has already conducted hearings on the legal and regulatory ramifications of sports betting in which representatives of the major professional sports leagues were among those invited to testify.

Pennsylvania Lottery to Go Online in May

The Pennsylvania Lottery announced that it will launch its online lottery games in May, first with online versions of various draw games. In June, the lo0ttery will add “virtual sports monitor games,” which are fast-draw lottery games offered in four- to five-minute intervals, 24 hours a day.

For the virtual sports games, bettors fill out lottery slips as normal, and an animated sport is then played out on video monitors to decide the winner. The idea is to have businesses like convenience stores and bars become retailers and show the games on a monitor.

The lottery also is going live with daily online keno games.

Florida Internet Cafes: Legal In City, Illegal In County

At least six internet cafes are operating in St. Augustine, Florida. They’re legal in the city but not in St. Johns County where St. Augustine is located. St. Augustine Police Department Assistant Chief Anthony Cuthbert said, “We’re just monitoring the legal landscape to see if anything comes out of that. For now, from what we can, tell they’re operating legally.”

St. Augustine was the base of Allied Veterans of the World, which operated internet cafes throughout Florida. In 2013 law enforcement arrested dozens of AVW owners and associates for money laundering and racketeering. The Florida legislature banned the cafes, causing hundreds to shut down.

St. Augustine City Attorney Isabelle Lopez said internet cafes are reviewed for zoning and building code compliance, like any other business. She said operators understand they could be investigated for hosting illegal gambling and having their machines seized by prosecutors.

“We’ve chosen not to attempt to get into the regulation of gambling, as that is a very complex field right now,” she said. “The state of Florida determines what is or isn’t a gambling establishment. I know a lot of people see internet cafes as gambling dens, and technically if they are comporting with the very peculiar requirements of state statute, they are not deemed gambling. They are sweepstakes, oftentimes set up as legal sweepstakes, regulated by Florida law.”

She added, “The compliance of whether or not you are truly a sweepstakes or a gambling facility has to do with the way the computer programs are set up. And that requires a tremendous amount of resources, so typically those things are handled by the attorney general or the Florida Department of Law Enforcement through a major inter-jurisdictional sweep.”

City Planning and Building Department Director David Birchim said the city doesn’t define internet cafes, so zoning for the difference between them and coffee shops that offer internet access is a problem.

In St. Johns County, no permits or permit renewals have been issued since state law changed following the Allied Veterans of the World investigation, said County spokesman Michael Ryan. The number of internet cafes dropped from 21 to one, Lucky Louie’s, and ″that business is operating without a business permit in St. Johns County,” Ryan said. The county has issued 32 citations, from $118 to $268, against Lucky Louie’s for operating without a business permit. The county also took the business to court, where a judge withheld adjudication and issued a fine, Ryan said.

 The county does not get involved in whether a business is involved in gambling. “That’s a state-regulated business. That’s why we’ve been in touch with the state attorney’s office,” Ryan said.

PokerStars Blocks Social Games Play from Washington State

Washington State residents who want to play on social games sites such as PokerStars free casino offerings have found themselves blocked after a federal court ruled such social sites constitute gambling and could violate state law.

The ruling has also led to at least four lawsuits reportedly being filed in the state against social casino sites.

The ruling came from the Ninth Circuit of the U.S. Court of Appeals which found that social casino games are illegal under the state’s existing gambling laws. The case revolved around a woman’s 2015 claim that she lost $1,000 in virtual chips at Big Fish’s social games site. She sued Churchill Downs, the then-parent company of Big Fish Casino over the loss.

The court ruled that under Washington law, gambling is “risking something of value upon the outcome of a contest of chance.” The appeals court ruled that the virtual chips are a thing of value, overruling a lower court.

PokerStars told USPoker.com that it has begun blocking state residents in the wake of the ruling.

“On Thursday, March 29, 2018, the U.S. 9th Circuit Court of Appeals ruled that, under Washington state law, free-to-play games violate state gambling regulations,” the company said in an email. “As a result, the Stars Group is immediately taking actions to block play related to social gaming from Washington state. We are reviewing the rulings and ensuring that our activities are in line with state regulations. We are hopeful the law will be clarified and that when it is, we will be able to reinstate all Washington players at their current status.”

Local reports also say that lawsuits involving free-to-play social casinos have been filed in the state since the ruling. The suits target social casino games from Huuuge Games, DoubleDown Interactive, High 5 Games and Playtika.

According to a report at Geekwire.com, the suits are similar in nature to the original suit which brought the appeals court ruling. Three of the suits name the same plaintiff. Lawyers for the plaintiff are seeking a class action status in the suits, the report said.

Poland Online Gambling Market Off to Slow Start

Poland’s new online gaming regulations went into effect in April 2017 and a year later, the newly regulated market is off to a slow start.

A review by Casino News Daily found that few major online sites sought licensing in the country, while Poland has backlisted about 1,600 online sites.

Under the country’s gambling act, online sports betting operators are able to apply for a license from the Finance Ministry. However, licensed sites must pay a 12 percent tax on betting turnover, rather than revenue.

That caused several online companies that targeted Poland as a grey market to stop offering services to Polish players. These included William Hill, bet365, and 888. They and most large international online sites have not sought licensing in the country, the report said, concluding that the high tax on turnover was causing companies to shy away from the market.

The new regulations also allowed state-run operator Totalizator Sportowy to offer casino games, poker, and bingo. Lawmakers announced that Totalizator Sportowy would add an online casino with different gaming options to service local players, but that site has still not launched.

Poland, meanwhile, has blacklisted 1,615 domain sites in the last year including major betting operators such as Betsson, Titanbet, and Intertops.

Despite the high number, a recent report by the Polish legal association Graj Legalnie recommended that the list should be updated more regularly and the Finance Ministry should tighten its grip on the country’s unregulated market. The report found that about 60 percent of the country’s online market is still dominated by unlicensed international sites.

Polish lawmakers recently announced that despite the high tax rate on licensed gambling services, the country’s regulated market delivered turnover of PLN3.3 billion (approximately $962.6 million) last year, up from PLN1.7 billion recorded in 2016.

Major Online Poker Tournaments Announced for May

PokerStars and PartyPoker will be duking it out this May with both scheduling major international online poker tournaments to run concurrently through the month.

PokerStars’ Spring Championship of Online Poker is returning May 6-21 with a $65 million guaranteed prize pool spread over 183 tournaments, making it the largest ever tournament series hosted online. There will be at least one tournament offering $1 million in guaranteed prize money every day, the company said in a press release.

In New Jersey, PokerStars is also running a NJSCOOP with a total guaranteed prize pool of $1.3 million making it the largest online series in the New Jersey market.

Meanwhile May 6-20, PartyPoker will offer its Powerfest online tournament series with $40 million in total guaranteed prize pools. It’s the biggest guaranteed prize pool PartyPoker has run and includes 366 events. The exact schedule has not yet been released, but PartyPoker did announce that 13 events will have a guaranteed prize pool of at least $1 million.

Cuba Libre Restaurant & Rum Bar, located in The Quarter at Tropicana Casino & Resort in Atlantic City, will offer its tempting a la carte brunch menu with festive specials from 11:30 a.m. to 4 p.m. this Mother’s Day.

Mom will be impressed by Executive Chef Kevin Couch’s featured specials, which include the Tortilla Española del Mar, Spanish omelette with shrimp, bay scallops, crabmeat, potato and fire roasted tomato salsa, served with a watercress and baby spinach salad, priced at $13.  Chef’s a la carte menu featuring modern Cuban dishes prepared on their unique stainless steel, wood-burning grill.

Atlantic City Ocean Resort Casino Will Join with Hyatt

Atlantic City’s Ocean Resort Casino—formerly the Revel casino—is affiliating with the Hyatt hotel chain, but will continue to be run by its own management.

Officials for the Boardwalk property announced the affiliation of the sixth anniversary of the original Revel’s opening. The property was bought by a group headed by Colorado developer Bruce Deifik in January for $200 million which is working towards a summer re-opening.

The property will join the Unbound Collection by Hyatt brand, a collection of new hotel properties, the release said.

“Hyatt has an incredible 60-plus-year legacy in the industry, and its loyal global customer base will have access to an authentic way to experience all that makes Atlantic City attractive and popular,” Deifik said in a press release. “We are thrilled and proud to be joining The Unbound Collection by Hyatt portfolio as we prepare for the resort’s opening this summer.”

Ocean Resort will continue to own and operate the 1,399-room hotel and the casino, but will utilize Hyatt’s reservation systems and other infrastructure. The site will also include a 32,000-square-foot spa under Hyatt’s exhale fitness and spa brand. The spa will feature 32 treatment rooms, a mind and body studio, and a retail boutique, the release said.

The original Revel casino—which closed in 2014—never enjoyed affiliation with a national and global customer base.

Also, the casino recently received approval from the New Jersey Division of Gaming Enforcement for the design of its gambling chips, and has been advertising numerous jobs throughout the resort, according to a report by the Associated Press.

The property is expected to include 1,399 hotel rooms in addition to a casino, five swimming pools, indoor meeting and convention space and outdoor event space, according to the release.

Meanwhile the neighboring Hard Rock Atlantic City—the former Taj Mahal casino—is also working towards a summer opening and has unveiled a preview of the refurbished casino. The company opened a preview center at the resort’s Tanger Outlets retail complex.

Todd Moyer, senior vice president of marketing for Hard Rock Hotel & Casino Atlantic City, told the local Press of Atlantic City that the preview center gives Hard Rock a presence in the city before the casino’s planned opening on the Boardwalk in a few months.

“It really truly is hanging a shingle in town, our first one in Atlantic City. We’re building a much bigger one down the street, but having a place we can call home is pretty cool,” Moyer said. “Atlantic City is on a roll. Things are really looking bright for this town.”

Hard Rock also announced it has signed a customer agreement with NetEnt, a provider of digital casino solutions, for the distribution of online games. Hard Rock is planning to offer online gambling in the New Jersey market when it opens this summer.

Hard Rock has also appointed an executive who will serve as a community liaison.

Rob Lee, former community outreach coordinator for Joseph Jingoli & Son—which is partnered in the casino with Hard Rock—has been appointed vice president of community relations and governmental affairs for the casino.

And in another development in the area, The Wheel at Steel Pier, a $14 million Ferris wheel located directly across from Hard Rock at the Steel Pier opened for the spring season last week.

The ride’s highest point is 227 feet from its base and 300 feet above sea level. It offers views of the city, the coast and the Atlantic Ocean on a 15-minute ride.

“This is a statement,” Anthony Catanoso, Steel Pier’s owner and president, told the Press. “It says, ‘You know what, Atlantic City is coming back. We can build beautiful, non-gaming attractions that are first-class, and people are going to come and ride them.”

New Jersey Governor Keynote Speaker at Gaming Convention

Newly installed New Jersey Governor Phil Murphy will be the keynoter for the 22nd annual East Coast Gaming Congress June 14 in Atlantic City at Harrah’s Waterfront Conference Center.

“As our state looks to the future of gaming, this conference presents an opportunity for industry leaders, stakeholders, and elected officials to discuss potential opportunities and ways that the industry is evolving,” commented Murphy.

The two-day conference will host more than 600 gaming operators, equipment manufacturers, regulators, attorneys and other professionals in the gaming industry.

Judge Rebukes Borgata Atlantic City Card Claim

A federal court judge has blocked Borgata Atlantic City in its case against card manufacturer Gemaco involving gambler Phil Ivey’s nearly $10 million win at the casino in 2012, saying Gemaco is only liable for the cost of the cards or about $27.

The casino charged that the cards had asymmetrical designs that differed for various card denominations. Ivey has openly admitted that he and a partner exploited the flaw to read the cards coming out of a baccarat shoe in a technique called edge sorting.

Ivey won nearly $10 million at the Borgata in 2012 with partner Cheng Yin Sun, prompting nearly six years of legal battles.

Borgata sued Gemaco for damages, but U.S. District Court Judge Noel Hillman ruled that other factors besides the card affect Ivey’s win and most the casino could win at trial from card manufacturer Gemaco was the cost of replacing the cards, according to the Associated Press.

The judge had previously ruled in an earlier case that Ivey and Sun didn’t meet their obligation to follow gambling regulations on four occasions while playing in 2012. The two players had a Borgata dealer arrange baccarat cards in the shoe so they could read them more easily. The judge ruled the players had to return the $10.1 million they won.

In Borgata’s case against Gemaco, the judge gave the casino and the card company three choices: Have the Borgata proceed to trial against Gemaco; affirm the judgment against Ivey and Sun to let them begin their planned appeal; or give the Borgata and Gemaco time to settle their part of the case, according to the AP.

Lawyers for the Borgata and Gemaco did not comment pending their decision on the judge’s options.
