Indiana Governor Keeps Options Open

Indiana Governor Eric Holcomb recently said he doesn’t know yet if he’ll sign Senate Bill 552, which was approved 38-11 by the Senate and now goes to the House. The measure would allow one of the two licenses of the Majestic I and II casinos to remain in Gary and the other to move to Terre Haute. It also would legalize sports betting.

Holcomb said, “I’ll need to take a deep dive into all the details because of how the conversation has expanded and what is all included, and I’ll be doing that in the coming days. I want to look at every word. I’m not opposed to looking at new ways with the existing licenses that are there. But this bill is far beyond just that, and, quite honestly, I need to do a lot more digging before I weigh-in on whether or not I’m for a final version of this bill.”

Holcomb said he’s aware that any change in gaming operations and locations impacts all the state’s casinos, plus casino gambling revenue the state and local governments depend on for funding public services.

The Senate bill also includes a “hold harmless” provision guaranteeing Hammond, East Chicago, Michigan City and LaPorte County would suffer no loss of gaming tax revenue for three years following the Gary casino’s move to a land-based facility. That likely would attract players from other regional casinos due to its more accessible location off Lake Michigan. The state and the city of Gary want to use the Majestic Star’s location in Buffington Harbor to develop an intermodal transportation and warehousing center.

Recently the Indiana Gaming Commission released a list of 16 companies, individuals and trusts that are investors in Spectacle Entertainment’s ownership transfer bid for the Majestic Star. The list of investors includes former state Rep. Dan Dumezich and family members and trusts in the name of the family members of basketball legend Larry Bird. The company wants to move the venue to Terre Haute.

Holcomb seems to support legalizing sports betting, observers said. He commented Indiana residents already bet on professional and college teams through illegal black market websites. “It’s happening now in Indiana. This bill would allow us to capture part of a market that already exists that we don’t now,” he said.

Can’t Beat ‘Em, Join ‘Em

Caesars Entertainment has signed an agreement with daily fantasy sports giant DraftKings—which now also offers sports betting and online casino games—to allow the company to access Caesars’ market in certain yet unidentified states.

Which markets DraftKings can enter is contingent on state’s passing applicable laws to allow sports betting and online wagering.

DraftKings will then promote Caesars Entertainment as its official casino-resort partner in those states, and Caesars will acquire an equity in DraftKings. The deal allows Caesars to continue offering their own branded sports betting and online casino apps in each of these jurisdictions.

The deal is the third involving a casino company acquiring a stake in a sportsbook company since the U.S. Supreme Court overturned a federal ban on sports betting last year. In August Boyd Gaming Corp. acquired a 4 percent stake in rival DFS company FanDuel while Eldorado Resorts acquired 20 percent in William Hill U.S.

Caesars, however, has not said how much of a stake it will acquire in DraftKings. Caesars will also receive a share of the revenue that DraftKings generates in states where the partnership is in place.

DraftKings is currently the leading online sportsbook in New Jersey through a partnership with Resorts Atlantic City. It also operates a live sportsbook in Mississippi. Along with the other DFS company, FanDuel, DraftKings controls 80 percent of New Jersey’s sports betting market.

Caesars currently has casinos in 13 states, including New Jersey, but the deal will not apply to New Jersey or neighboring Pennsylvania, where Caesars also has casino properties. Caesars officials said the company will launch its own brand in Pennsylvania, which has just begun to see sportsbooks go online.

Caesars said in a press release it does plan to operate a suite of online gambling products alongside DraftKings in other markets that permit multiple points of entry.

Mark Frissora, president and CEO of Caesars Entertainment, said in the release that the deal should create new revenue with sports-themed guest experiences at the casino giant’s resorts across the country.

“Caesars’ agreement with DraftKings, their first multi-state partnership, brings together the established leaders in gaming, daily fantasy sports and sports betting to provide customers more options,” he said. “This alliance is the latest initiative by Caesars to capitalize on our database, generate a new revenue stream in a growth market and raise our profile in sports, in part by creating new sports-themed guest experiences at our resorts across the country.”

Oscars Betting Called a Success in New Jersey

Though official figures haven’t been released, New Jersey’s experiment with allowing bets on the Academy Awards appears to have been a success.

The state was the first to allow Oscar betting in the U.S. and bookmakers said bettors embraced the opportunity.

“The Academy Awards was a roaring success,” William Hill sportsbook director Nick Bogdanovich told the Las Vegas Review Journal. “It brought people to the betting window, which is all you want. The average bet was like 20 bucks, but people couldn’t get enough of it and we won a few bucks, so it was a win-win.”

There were, however, some anomalies in the betting due to rumors that circulated on social media on who eventual winners would be. The biggest was a rumor that involved Yorgos Lanthimos, who directed best picture nominee The Favourite. Lanthimos opened as a 50-1 long shot, but the odds eventually dropped to six to one due to late betting, the Review Journal reported.

The betting was spurred by a rumor on social media that results had been leaked and Lanthimos would win the award—a rumor which was ultimately incorrect. The betting was so intense, some books in New Jersey and also on unlicensed offshore sites took the odds for Lanthimos off the board.

“It was all over Twitter that someone knew he’d won,” Bogdanovich told the newspaper. “In this day and age of social media, as soon as someone sends it out there, it becomes gospel. They were out there betting him with both hands. We kept getting ticket after ticket. The liability was adding up. Eventually we ended up taking it down in case the rumor was true.”

Eventually, Alfonso Cuarón, the heavy favorite, won best director for “Roma,” but some analysts noted that the rumor involving Lanthimos shows that regulated sportsbooks can spot and handle betting anomalies.

Bogdanovich said he also expects a Nevada book will win approval from the Nevada Gaming Control Board to allow betting on the 2020 Oscars.

“They’ve approved other things like the Heisman Trophy and Super Bowl MVP,” he told the Review Journal. “It’s very possible.”

In New Jersey, William Hill took wagers on the big six categories of best picture, best actor, best actress, best supporting actor, best supporting actress and best director.

Best picture generated the most bets with winner Green Book, closing at 2-1 odds, the paper reported.

Icahn Moves on Caesars

Billionaire corporate raider Carl Icahn has joined an expanding group of activist investors who believe their Caesars Entertainment stock is undervalued and that the company needs new ownership to redress that.

Caesars has been under pressure from investors to do something dramatic since it exited a lengthy Chapter 11 reorganization in October 2017—the result of a previous sale, ironically enough—a leveraged buyout that saddled the company with tens of billions of dollars of debt.

Despite Caesars’ size and diversity—more than 40 casinos in 13 states, the World Series of Poker, a megaresort under development in South Korea—the stock has never recovered. Last summer and fall, it dropped below $6. It was around that time that the company rejected an offer from billionaire restaurateur and reality TV star Tilman Fertitta to merge with his Golden Nugget casino chain in a reverse buyout valued at $13 a share that would have put him in control of the combined companies. It was also at that time that CEO Mark Frissora tendered his resignation. Reports are that Fertitta, who owns around 1 percent of the stock, is still interested in a combination.

The stock has since traded above $9, and Icahn has snapped up a 9.78 percent stake at those prices. According to news reports, he has financial exposure to another 10.7 percent through a financial swap.

The 83-year-old financier has owned several casinos and casino companies in the past. By all accounts, though, he is not interested in adding Caesars to the list. Rather, the company needs “new thought, new leadership and new strategies,” as he put it in a regulatory filing announcing his stake.

“The board should conduct a strategic process to comprehensively assess the best path forward for Caesars, and we believe that shareholder value might be best served, and enhanced, by selling the company,” he said.

In the meantime, he wants the company to drop its search for a replacement for Frissora, who has agreed to say on through April. He also wants a seat on the board of directors.

Caesars responded that it “remains open to all reasonable alternatives to enhance value for Caesars’ stockholders and has and will continue to evaluate strategic alternatives presented.”

It added, “The board and management have engaged in discussions with Mr. Icahn and expect to continue a constructive dialogue. The company intends to carefully evaluate Mr. Icahn’s suggestions, including his request for board representation.”

News of Icahn’s investment bumped the stock 6 percent, suggesting that Wall Street likes the idea of a sale. Effecting one, though, given Caesars’ size, could prove a regulatory and antitrust nightmare.

Recent deals, such as Penn National Gaming’s acquisition of regional casino rival Pinnacle Entertainment, needed a third party—Boyd Gaming, which bought four Pinnacle casinos—to pass Federal Trade Commission review. Penn National will emerge from the acquisition with 42 casinos in 19 states.

As for Las Vegas-based Boyd, it now operates 29 casinos in 10 states, 12 of which are in Nevada. Reno-based Eldorado Resorts, another major acquirer, has 27 casinos in 13 states.

The Caesars portfolio includes nine casinos in or around the Las Vegas Strip, which means MGM Resorts International, which operates 10 Strip resorts and owns 50 percent of the CityCenter resort complex, is likely out of the picture.

States May Sue To Overturn New Wire Act Ruling

Several state attorneys general, including in New Jersey and Pennsylvania, are expected to sue the federal government to try to overturn the recently announced new Justice Department interpretation of the federal Wire Act.

In 2011 the DOJ’s Criminal Division declared, “the prohibitions of the (federal Wire Act of 1961) are limited to (interstate) sports gambling and thus do not apply to state lotteries at all.” In November the Criminal Division overturned that declaration by stating that the Act’s ban on the use of a wire for sending data on wagers, “are not uniformly limited to sports gambling.”

On February 14 the New Jersey Senate President Steve Sweeney said his state will seek a declaratory judgment against the Justice Department. Now the New Hampshire Lottery has indicated it will follow suit. Others with an interest in this issue might also, such as MGM Resorts or DraftKings.

Professor Steve Silver of the University of Maine School of Law told Legal Sports Report: “This entire situation highlights the need for Congress to revisit the Wire Act. Federal gaming policy is and has long been largely incoherent and inconsistent.”

Sweeney has written a letter to U.S. Deputy Attorney General Rod Rosenstein asking the federal Department of Justice to withdraw its newly released opinion on the 1961 federal Wire Act.

The new opinion calls into question the legality of any online gambling that involves the transfer of information across state lines. New Jersey has built a thriving online gambling industry since a 2011 opinion by the DOJ—which the new opinion reverses—cleared the way for intrastate gambling.

“This legislation has generated more than $1 billion for our then struggling casino industry and hundreds of millions in revenue, directly and indirectly, for our Treasury, brought back thousands of jobs, and saved thousands more,” Sweeney wrote. “The goal of our internet wagering law, as stated by its Senate sponsor Raymond Lesniak, was to revitalize Atlantic City’s struggling casino industry which had lost 15,000 jobs and to make New Jersey a national and international hub for internet gaming.”

Lesniak has been authorized by Sweeney to respond to the DOJ opinion on behalf of the state and has said he plans to challenge it in court. However, Lesniak has said he will wait 30 days to allow recently confirmed U.S. Attorney General William Barr to take an “honest look” at the opinion before moving ahead with potential legal action.

Lesniak has also filed a Freedom of Information Act request to determine who lobbied the DOJ to rewrite the Wire Act opinion. He joins with the state’s Attorney General Gurbir Grewal who has also filed a freedom of information request. Both charge that the new DOJ opinion was strongly influenced by the lobbying of Las Vegas Sands owner Sheldon Adelson who has funded a personal crusade to have online gambling banned in the U.S.

Sweeney said that the opinion “has already caused harm to the State of New Jersey,” since the Pennsylvania Gaming Control Board has halted a plan to place its internet gaming equipment in Atlantic City due to concerns that the placement would not be consistent with federal law.

Sweeney said the 2019 opinion “flies in the face” of the 2011 interpretation and that the new opinion is a “tortured analysis of sentence structure and comma placements” to interpret the “clear language” of the Wire Act and runs counter to a Fifth Circuit Court of Appeals opinion and a “thorough review” by the justice department in 2011.

Atlantic City’s Ocean Resort Sees Executive Changes

The New York-based hedge fund Luxor Capital Group that is taking over ownership of Atlantic City’s Ocean Resort casino seems to be sweeping clean top executives at the casino.

Frank Leone (l.), the property’s former CEO, and Alan Greenstein, former chief financial officer, were both recently fired from their posts.

Eric Matejevich, former chief operating officer of the now-closed Atlantic Club Casino Hotel, has been named as CEO on an interim basis. Terry Glebocki, a former corporate chief financial officer of Tropicana Atlantic City, will replace Greenstein, according to a press release.

“As we move forward with enhancements to the guest and player experience—including substantial increases in our entertainment programming and player events throughout the year, adding a world-class buffet, additional suites and rooms, incremental investments on the casino floor and other exciting projects, Terry and Eric’s expertise will be invaluable in continuing our momentum,” the release said.

The Ocean Resort is the former Revel casino, which closed in 2014. It was purchased in early 2018 by Colorado-based developer Bruce Deifik for $229 million from Florida-based real estate developer Glenn Straub. The deal was backed by Luxor and JPMorgan Chase Bank.

The casino reopened in June. Luxor announced last month is was taking over ownership of the casino, which has been losing money steadily since the fall and has struggled near the bottom of the city’s nine casinos in revenue.

Leone and Greenstein were both part of Straub’s casino plan, TEN, which never materialized and were kept on by Deifik. Greenstein was also the CFO for the original Revel casino.

“We wish to thank Alan Greenstein for his years of service and wish him success in his future endeavors,” the Luxor statement said. “We also extend our good wishes to Frank, who will be pursuing other opportunities after having provided important leadership for Ocean Resort Casino.”

This month, the New Jersey Casino Control Commission approved a divestiture trust agreement that transferred majority control from Deifik to Luxor.

In a brighter story for the casino, the city’s new Arena Football League franchise—which is still in the process of picking a name—has named Ocean Resort to official host hotel for the team in a marketing deal. Special rates and discounted tickets will be offered to visiting team fans during the season.

Chris Christie Named to Sports Betting Hall of Fame

Former New Jersey Governor Chris Christie’s long fight to overturn a federal ban on sports betting has earned him honors from the trade group Sports betting Community.

Christie will be inducted into the group’s Sports betting Hall of Fame—created in 2016—at a ceremony as part of the Betting on Sports America conference April 23-25 in New York and New Jersey.

Christie led New Jersey’s fight to overturn the Professional and Amateur Sports Protection Act which created a ban on sports betting in all but four U.S. states. By the time the U.S. Supreme Court overturned the federal law, current New Jersey Governor Phil Murphy was in office, but Christie’s name topped the state’s lawsuit through most of its journey through the courts.

The award comes as Christie continues to up his public profile, having served as head of President Donald Trump’s transition team and recently authoring the book “Let Me Finish.”

Christie also delivered the keynote address at the winter meeting of the National Council of Legislators from Gaming States in New Orleans where he addressed New jersey’s long fight to implement legal sports betting.

“The leagues—the arrogance of the leagues—is the other thing we need to talk about,” Christie said at the meeting. “All of you now are going to have these folks coming in to your state capitals and arguing to you that they should somehow now get something for free from you, that they were unwilling to settle on when they were in the midst of litigation.”

Christie was picked for the hall due to his persistence in challenging PASPA.

“Governor Christie is the first politician we have inducted into the Sports Betting Hall of Fame, but he is there with good reason,” said Rasmus Sojmark, Founder and CEO of SBC in a press release. “Without the political will from the governor’s office it is questionable that PASPA would ever have been challenged in the courts.”

Christie said he is proud to be named to the hall.

“Sports betting was held back for too long by the unfair federal laws, so I was more than happy to be the first to make a stand against them,” he said in the release. “I’m very proud and gratified to be recognized by the sports betting industry in this year now that PASPA is a distant memory.”

Golden Nugget Atlantic City Launches Online Sportsbook

Golden Nugget Atlantic City has launched a new online sportsbook to go along with its industry-leading NJ online casino platform.

The online sportsbook is the 13th in the state’s market. Golden Nugget also operates a live sportsbook at its Atlantic City casino. The new online is live for desktop and mobile devices, including iOS and Android, the company said in a press release.

Since Golden Nugget Owner Tilman Fertitta also owns the NBA’s Houston Rockets, the sportsbooks cannot take action on NBA games under New Jersey’s regulations.

Racetrack Alleges Bribery in Massachusetts’ Suit Versus Wynn

Sterling Suffolk Racecourse LLC is proving to be an especially sore loser when it comes to Wynn Resorts. It is using the recent settlement the Las Vegas-based gaming giant made with the Nevada Gaming Control Board as evidence that Wynn was unsuitable to hold a license in Massachusetts, where in 2014 it beat Suffolk Downs for the Boston Metro license—and as a result it is now poised to open the $2.6 billion Encore Boston Harbor in June.

That settlement has been used to amend the lawsuit originally filed in September by Sterling Suffolk. It is suing in U.S. District Court asking for a jury trial and seeking damages of $3 billion. It alleges racketeering and violations of the state’s gaming laws. It names in the lawsuit Steve Wynn, current Wynn CEO Matt Maddox, former Wynn counsel Kim Sinatra; and a Wynn real estate partner, FBT Everett Realty LLC.

Its lawsuit now includes the fact that Wynn and the Nevada board last month settled a 10-count complaint that the company had for years turned a blind eye to allegations of sexual harassment against its founder, and CEO Steve Wynn.

The Nevada Gaming Commission will consider the settlement at its February 28 meeting. It is expected to announce a fine of the company at that time.

The complaint cites “Steve Wynn’s long and sordid history of inappropriate and at times criminal sexual conduct.” Wynn, who has maintained his innocence of any inappropriate behavior, resigned as CEO and chairman a year ago after a piece came out in the Wall Street Journal detailing many of the allegations against him, including a $7.5 million settlement he made to an employee who claimed he sexually assaulted her. He also divested himself of all Wynn stock.

Wynn Resorts responded to the newest allegations: “This is a repackaging of the baseless claims Suffolk Racing has been making since they failed to win a license based on the merits four years ago. We will continue to defend ourselves in court.”

The lawsuit accuses Wynn of “fraud, kickbacks, political cronyism crossing the line of legality.” The “racketeering” accusation refers back to Suffolk’s accusations that former Massachusetts Gaming Commission Chairman Stephen Crosby made backroom deals with city leaders to bring the license to the city of Everett.

The amended RICO complaint discusses a supposed hidden deal between Crosby and land developer Paul Lohnes, who was the majority owner of the 36 acres of former Monsanto chemical that eventually became the current site of the casino. It alleges that Lohnes and Crosby met many times in 2012 while Wynn was seeking place to build a casino after he failed to complete a deal to build a casino near the Gillette Stadium.

Lohnes and Crosby are longtime friends who served together in the National Guard. After Lohnes became wealthy he invested in a Crosby publishing startup and subsequently lost a lot of money.

Several decades later, goes the narrative, Lohnes used this earlier association to leverage the Everett land deal, with the foreknowledge that Crosby would be secretly pulling for the deal with Wynn. It notes several social gatherings in 2012, shortly after Crosby was named MGC chairman, where Lohnes and Crosby appeared together.

Crosby resigned in September from the panel in response to constant claims of by Wynn Resorts and the Mohegan Sun, which was the partner with Suffolk Downs in the unsuccessful bid.

Wynn was awarded the gaming license in December 2014, with a vote of 3-1, with Crosby recusing himself.

The amended complaint alleges that Everett Mayor Carlo DeMaria got kickbacks because of a disputed land acquisition agreement and hidden deals. The defendants “conspired to fix the application process,” states the amended lawsuit. “The Defendants herein conspired to, and did in fact, circumvent the safeguards and protections that the Gaming Act was intended to provide.”

Mayor DeMaria in a statement called the Suffolk Downs’ claims “blatantly false,” adding “To be clear and unequivocal, at no time did I engage in any improper activity of any sort in connection with the casino project as Mayor of Everett. The collateral allegations reported in the lawsuit about me are false, scandalous and offered by those who are seeking only to engage in a political attack against me.”

Steve Wynn’s attorney Brian Kelly, called the latest broadside, “more nonsense from a disgruntled competitor which we will file a response to soon.”

The Massachusetts Gaming Commission offered “no comment” to the latest development.

Whether the Encore Boston Harbor actually opens on schedule is still up in the air since the Massachusetts Gaming Commission is still reviewing what action it might take after it recently concluded its own yearlong investigation of the company’s actions, and whether it tried to hide Wynn’s history when the company was applying for the license in 2015. It is also determining the continued suitability of the company under its new regime, headed by Maddox.

Clyde Barrow, the longtime gaming expert who specializes in New England, told the Boston Herald that the allegations of kickbacks against DeMaria “seems like a pretty explosive allegation to make if you don’t have evidence to back it up.” He added, “I don’t think any of this is going to derail whatever ruling they’ve already decided to make on that case. They’ve conducted their investigation.”

Maddox recently sounded optimistic about Wynn’s chances of retaining its license when he soothed investors and told them the casino would open on time.

Crosby’s replacement as chairman, Cathy Judd-Stein, recently joined the panel. Its decision on Wynn had been postponed for several months due to a lawsuit by Steve Wynn claiming that some documents obtained by MGC investigators involving him violated attorney client privilege. Another of several hearings has been scheduled in March before a Nevada judge whose final decision could be months from now.


MGM Springfield

Although gaming is the primary reason for the existence of the $960 million MGM Springfield, which opened in August at the South End of the state’s third largest city, the 125,000 square foot facility with 2,500 slot machines and 125 gaming tables is part of a downtown complex on 14.5 acres that is upgrading the downtown with top-end hotel rooms, upscale dining, event space, live entertainment, and tribute to the city past.

MGM spokesman Saverio Mancini told the Connecticut Post, “Springfield is special and that was the whole idea behind how the casino was developed. MGM spent nearly $1 billion to celebrate Springfield.” He added, “We did not want a glitzy Las Vegas appearance but rather one that blended with the city’s architecture and celebrated its successes. And we think it has been done.”

The main entrance is the salvaged facade of the city’s historic Chandler Hotel, which in its earlier incarnations hosted presidents James K. Polk and James Buchanan. It also boasts an aluminum sculpture that is a tribute to the revival of the city center after the devastation 2011 tornado devastated the area.

The interior includes a lobby with a library of books, many of which were written by authors of the region. One of those writers, poet Emily Dickinson, the “Belle of Amherst,” a nearby town, is honored with an homage. As is Charles Merriam, the first publisher of the Merriam Webster Dictionary.

There are also tributes to Indian Motorcycle, which was first manufactured in Springfield, and to one of its most celebrated favorite sons, Theodore “Dr. Seuss” Geisel.

Keven Kennedy, Springfield’s chief development officer, told the Post that when the city was accepting bids for a casino that it demanded much more than just a casino. “For us, this was not just about gaming but developing something more,” he said. “We did not want a traditional fortress of a casino but rather something that would reflect and be part of Springfield.”

The city encouraged the casino to not only use the old hotel façade but to also employ the 129-year old First Spiritualist Church. Trees that were removed to make way for the casino were made into hotels for the lobby.

The facility has plenty of non-gaming amenities, such as a cinema, event space, “Top Golf Swing Suite” and bowling alley. Restaurants include celebrity chef Michael Mina’s Cal Mare, celebrating Italian seafood, and the Chandler Steakhouse (recalling the landmark hotel) operated by another celebrity chef, Meghan Gill. If you want casual dining, there’s the South End Market, which has Bill’s Diner and Jack’s Lobster Shack.

The casino now operates two of the big entertainment venues downtown, including the MassMutual Center and Springfield symphony hall. Kennedy explains, “That is part of the cooperative agreement between MGM and the city. MGM had to agree to use our existing facilities. We wanted interaction with the community and wanted them to be part of us, not us them.”

The 252-room hotel expands on these themes with a Presidential Suite that has a chandelier which features hats worn by characters from Dr. Seuss’s books. Or a hallway with rugs that have Dickinson poetry woven into the fabric.

Mayor Dominic Sarno credits the casino with helping to revive the downtown. “We’re proud to have them here,” says Springfield Mayor Dominic Sarno. “MGM has been a wonderful addition and partner to the city,” he adds, “They’ve not only had a positive effect in Springfield, but also in Western Massachusetts and New England.”

Meanwhile, MGM Resorts International President and CEO James J. Murren told a conference call of stock analysts that despite less than predicted returns for the MGM Springfield that some aspects of the resort are actually ahead of the game, such as business at the 250-room hotel (the one with the Dr. Seuss chandelier.)

 Murren characterized business at the Springfield operation as “slower, but ramping.” Murren, who just visited Springfield, enthused, “I was just there. Oh gosh, it’s a beautiful property and great. Unbelievable feedback we get from customers, from the gaming commission in Massachusetts, from the elected officials and our food and beverage operations are ahead of target. Our hotel business is ahead of target. Our gaming business is slower, but ramping. We actually saw the almost exact same thing at National Harbor, as we built into a brand-new market for us. So, we expect that, given the quality of the assets and the people working there and the word-of-mouth marketing, we are going to be a little bit more tactical in marketing and reminding people that we are there, particularly, leading up to a competitor in Everett, that’s opening up in the second half of this year. But we view its operating future very much the same as what we’ve seen in a different scale, with a smaller investment up there than at National Harbor, but what we are seeing in our other new properties.”

Nevertheless, it is undeniable that the MGM Springfield’s revenues are lower than expected. For example, MGM assured the Massachusetts Gaming Commission that it would have $418 million in annual gross revenue its first year. That works out to be $34.8 million a month.

However, in December the property generated $21,583,225 in gross revenue and in the just released January figures were even more dismal: $19.7 million, the lowest since opening and an 8.73 percent drop in one month. Those figures, released by the MGM, came days after the “ramping” claim.

Michael Mathis, president and chief operating officer of the property, issued a prepared statement: “As we enter our sixth month of operation, we continue to gain valuable insights on the market. Our business strategy continues to evolve as our relationship with existing customers grows, and as thousands of new guests enter our loyalty program. This includes new features and promotions on the casino floor and more dining and entertainment like brunch in Cal Mare and ROAR comedy in our historic Armory. We remain grateful for the ongoing support of the New England region and look forward to an exciting 2019 bringing more great shows to downtown and introducing legalized sports betting for the first time in the Commonwealth.”

Both the MGM Springfield and Plainridge Park Casino report their monthly revenues to the commission, which releases them to the public. The Springfield facility is taxed at 25 percent

Plainridge, which is a slots-only casino, reported $12 million in January, compared to $14 million in December. This dip occurred the previous January, possibly indicating a slowdown each year at this time.

SJM to Complete Lagerfeld-Branded Hotel

Leong: Grand Lisboa will bring something new to Cotai

Macau casino operator SJM Holdings Ltd. says work will continue on a hotel named for superstar couturier Karl Lagerfeld in the wake of his death. The 80-something designer died last week in Paris; news of his passing was announced on Tuesday.

SJM stated that it was “deeply saddened” by his death, and said he hotel will stand “as a legacy to his creative genius,” according to the Washington Post. The resort will also feature a Versace-themed hotel.

Lagerfeld first signed the deal in 2017, and the hotel was supposed to have opened in 2017. Construction is ongoing, and earlier in February SJM CEO Ambrose So said he is “confident” that the property will be completed and ready for licensing “within 2019.”

According to GGRAsia, SJM Holdings said the hotel will have up to 270 guestrooms and suites in a “20-storey exclusive tower.” An executive of Karl Lagerfeld Group BV called the development “an important milestone” in the development of the brand and business “globally and specifically in Greater China.”

Though SJM is late to the game on Cotai, where market rivals Wynn Resorts, Sands China, Melco Resorts and others have been operational for several years, Executive Director Angela Leong said the property will distinguish itself with new and different offerings.

“We will have new hotels and other services that can attract more tourists, also renowned restaurants. I believe it will give a good image to Macau. We can’t repeat what already exists in Cotai. We will be the last and we will try to bring new offerings,” Leong told local press.

U.S. Casinos Post Best Year Ever

U.S. commercial casinos booked nearly $42.7 billion in gaming revenue in 2018, a new record for the industry.

Spurred mainly by major openings in Massachusetts, New York and Atlantic City, revenue jumped 4 percent over 2017, according to “The Adams Revenue Report,” a performance review encompassing 23 commercial casino markets compiled by gaming analyst and consultant Ken Adams.

It was a “good year,” according to Adams, who also credited it to increases in machine gaming numbers and the nationwide introduction of sports betting.

Harrah’s Philadelphia to Open Topgolf

Harrah’s Philadelphia Casino and Racetrack in Chester, Pennsylvania opened Topgolf Swing Suite, an interactive entertainment space for social gatherings and practice sessions, on February 15 at noon, after a celebratory ribbon cutting ceremony.

Located in the back of the casino floor, the Topgolf Swing Suite features three simulator bays that host a variety of virtual games available to guests. This includes the popular Topgolf target game, as well as Hockey Shots, Baseball Pitching, Football Passing, Zombie Dodgeball, Carnival Classic and more.

Each Swing Suite allows up to eight guests to play, eat and drink in each bay. The spaces are available to rent for business and social gatherings, including but not limited to bachelor and bachelorette parties, birthdays, team building events and corporate meetings. Each bay is equipped with comfortable lounge seating and mobile food and beverage ordering, so guests can eat and drink while playing games.

“We are proud to team with Topgolf to provide a new kind of interactive social experience to Harrah’s Philadelphia,” said Harrah’s Philadelphia VP and Assistant General Manager Tracey Witchko. “When planning the redevelopment of this area of the casino floor, our focus was to add more diverse and engaging entertainment options for our guests, and we think the addition of the Topgolf Swing Suite, coupled with The Book for sports wagering, definitely accomplishes that goal.”

Guests can rent a suite for $25 for every 30-minute play period.

Washington D.C. Approves Sports Betting Contract

The Washington D.C. City Council approved a plan to bypass the public bidding process and award a mobile sports betting contract to its lottery provider Intralot on a second reading.

The council also approved resolutions to allow the city’s lottery to begin contract negotiations once the bill is signed by Mayor Muriel Bowser. All D.C. laws, however, still have to be approved by Congress.

There has been vocal opposition on Council about bypassing the bidding process, but proponents have insisted that the District needs to move quickly before neighboring states Maryland and Virginia approve sports betting.

Still, Council Member David Grosso said before the vote that Intralot should not be granted the contract and that the company had recently made significant contributions to council member campaign funds.

“It is not an emergency. It is a giveaway,” he said before the vote according to a report at Sports Handle. “We previously noted the downgrade of Intralot’s Moody’s bond rating. That should be enough to show that there is no emergency here … the only emergency is for Intralot.”

The deal has also been criticized for stifling competition in the district’s market and offering consumers little choice in who to play with.

However, City officials estimated it would take 27 months to secure a sports betting contract going through regular bidding procedures. That delay would cost the district more than $60 million, they said.

Washington’s sports betting bill will allow for sportsbooks at sports venues, but the district does not have any operating casinos.

Connecticut Lawmaker Says Integrity Fee an Option in Sports Betting

Connecticut State Rep. Joe Verrengia, chairman of the powerful Public Safety and Security Committee said last week that the possibility of an “integrity fee” as part of a sports betting bill remains a possibility.

So far six states have adopted legislation that does not have a fee for the professional sports leagues.

Before the Supreme Court lifted the ban on sports betting, Verrengia held hearings at which he said he wasn’t interested in “lining the pockets” of the sports leagues, but last week he said, “Given the time that has passed, we’re obviously going to revisit the issue of an integrity fee.”

He is interested in possibly generating a fee that might be used to support youth sports in the state. He has raised the subject of partnering with the leagues for that purpose with league representatives. “They were all for it. They thought it was a great idea because it would benefit the state and have also help them grow their market as well. I would like to see that happen,” he told Legal Sports Report.

The representative indicated that any bill include a provision for mobile apps that allow sports betting statewide. “The evidence is overwhelming that that’s where the real money is – in the mobile platform,” he said.
